No. 72/Bill No. 24 <br />PLACE: Council Chambers <br />Kona, Hawaii <br />TIME: 9:01 a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Committee on Finance, to which was referred Bill No. 24, reports as follows: <br />Bill No. 24, transmitted by Council Member Brenda Ford, via Communication No. 24 dated <br />January 3, 2013, amends Chapter 2, Article 42, Section 2 -214 of the Hawaii County Code 1983 <br />(2005 edition, as amended), relating to a restrictive covenant for deeds to lands or easements acquired <br />with funds from the Public Access, Open Space, and Natural Resources Preservation Fund (PONC). <br />Bill No. 24 requires a specifically written covenant be incorporated into and recorded with the deed, to <br />ensure the land or parcel remains under County ownership in perpetuity. <br />Finance Director Nancy Crawford was present before Your Committee for questions. <br />Ms. Crawford had no concerns or objections to the language proposed in Bill 23, and stated that the <br />language replicates what is law in the Hawaii County Charter. <br />Several Council Members communicated their support of Bill 24. Ms. Wille expressed her appreciation <br />of the clarification that Bill 24 will have on County deeds, and noted that it will help prevent any future <br />controversy. <br />Ms. Ford suggested the Finance Department go back and revise any existing land deeds acquired by <br />means of PONC funds to include such language, as proposed in Bill 24. This would prevent the sale, <br />mortgage, trade or transfer of those lands in any way. <br />FC Report No. 27 <br />
