Pursuant to Section 92-5(a)(4), Hawai`i Revised Statutes, as amended, we request
attorney-client confidential discussion in executive session to consult with the County Council
on questions and issues pertaining to its powers, duties, privileges, immunities and liabilities
regarding the above-entitled matter; a lawsuit for damages filed on June 28, 2012. We ask that
this case be placed on the Council's February 20, 2013 agenda.
