Re: Operating Budget
Pursuant to the recently added Section 10-16 of the County Charter, which was approved during
the November 2012 election, .25% of real property tax revenue (including penalty and interest)
must be transferred from the General Fund to the newly created Public Access/Open Space and
Natural Resources Preservation Maintenance Fund, beginning with the first quarter of 2013.
Enclosed is a bill for an Ordinance amending the Operating Budget by appropriating $250,000 to
the new Transfer to Public Access/Open Space Preservation Maintenance Fund.
In order to ensure that the first transfer may be done by the deadline as required by the County
Charter, we are requesting that this bill be waived from the Finance Committee and be placed on
the February 20, 2013 Council agenda.

A. REQUEST:
To amend the FY12 General Fund operating budget by increasing revenues and appropriations by the
following:
Increase Public Service Co Tax estimated revenues by250,000
Add new appropriation Transfer to Public Access, Open Space, and Natural Resources Preservation
Maintenance Fund for$250,000
We are asking that the Finance Committee be waived to ensure that the first transfer may be done by the
deadline as required by the County Chareter.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):

RE: Bill No. 34 : An Ordinance to Amend Ordinance No. 12-86, the Operating
Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2013 Relating to the
Transfer of Funds to the Public Access, Open Space and Natural Resources Preservation
Maintenance Fund (PONC).
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
