�JMtY Os N,�, COUNTY OF HAWAI'I STATE OF HAWAI'I rE os.M':M RESOLUTION NO. 57 13 RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM KAHIKINI STREET TO A SEWER, UTILITY, AND ACCESS EASEMENT FOR MOHOULI SENIOR PHASE I, LLLP (TMK 2-4-001:177), THE HAWAI'I ISLAND COMMUNITY DEVELOPMENT CORPORATION (TMK 2-4-001:184), AND THE COUNTY OF HAWAI'I (TMK 2-4-001:176), SITUATED IN WAIAKEA, DISTRICT OF SOUTH HILO, HAWAI'I. WHEREAS, applicant Mohouli Senior Phase I, LLLP has requested to extend the public sewer in accordance with Section 21-26, Hawai'i County Code to service TMK 2-4-001:177, which is owned by the County of Hawai'i and leased to Mohouli Senior Phase 1, LLLP; TMK 2- 4-001:184, which is owned by the County of Hawai'i and leased to the Hawai'i Island Community Development Corporation; and TMK 2-4-001:176, which is owned by the County of Hawai'i for future development of a Fire Administration Support Complex; and WHEREAS, applicant Mohouli Senior Phase I, LLLP will bear the full cost of the extension and will be eligible to exercise conditions under Section 21-28(a), Hawai'i County Code, granting reimbursement to the applicant for 10 years after completion of the extension of one-half of all monies for sewer charges collected by the County from other properties, if any, connecting to the extension provided that the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension; and WHEREAS, the reimbursable public sewer extension is the upstream segment from the existing terminal manhole within Kahikini Street up to the stubouts within TMK 2-4-001:184 for connection of Lots 2, 3-A, and 3-13; and WHEREAS, upon final acceptance of the sewer extension, it will become part of the Public Sewer System and will become the responsibility of the County of Hawai'i Wastewater Division to maintain; and WHEREAS, the Director of Environmental Management has recommended approval of the extension according to Section 21-27, Hawai'i County Code; and Attachment "A" is an application for sewer extension from Mohouli Senior Phase I, LLLP with a location map; and WHEREAS, sewer extensions are beneficial to the community by reducing the amount of potential pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, Section 21-26, Hawai'i County Code, requires that the Council approve all sewer extensions. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that the public sewer extension from Kahikini Street to a sewer, utility, and access easement for Mohouli Senior Phase I, LLLP, the Hawai'i Island Community Development Corporation, and the County of Hawai'i, as delineated and described in Attachment"A" is hereby approved. BE IT FURTHER RESOLVED that the request of the applicant to be reimbursed for the cost of the sewer extension in accordance with Section 21-28(a) is hereby approved. BE IT FINALLY RESOLVED that that the Clerk of the County of Hawai'i transmit copies of this resolution to the Departments of Finance, Public Works and Environmental Management.
