RESOLUTION NO. 61 13
A RESOLUTION URGING THE HAWAII STATE LEGISLATURE TO PASS
LEGISLATION PERMITTING THE COUNTY OF HAWAII TO EXPEND A PORTION
OF THE COUNTY'S SHARE OF FUEL TAX REVENUE FOR THE MAINTENANCE
OF SUBSTANDARD PRIVATE SUBDIVISION ROADS WHICH ARE USED BY THE
PUBLIC.
WHEREAS, in Section 243-6 of the Hawai`i Revised Statutes, the "county of Hawai`i
fuel tax" shall "be paid over to the director of finance of the county of Hawai`i for deposit into
the fund known as the `highway fund' created by section 249-18"; and
WHEREAS, Section 249-18 of the Hawai`i Revised Statutes, dealing with the highway
fund, does not currently allow for highway fund money to be spent on the maintenance of
substandard private subdivision roads which are used by the public; and
WHEREAS, Senate Bill No. 382 and House Bill No. 101 were introduced at the Hawai`i
State Legislature on January 18, 2013—bills which would permit the county of Hawai`i to
appropriate a share of fuel tax revenue for the maintenance of private subdivision roads,
provided that they are substandard and utilized by the public; and
WHEREAS, many substandard private subdivision roads within the county of Hawai`i
are utilized by the public, but not currently eligible for improvements funded through money
derived from the county of Hawai`i fuel tax; and
WHEREAS, substandard private subdivision roads may provide for hazardous driving
conditions, not only for residents of private subdivisions, but also for county of Hawai`i
emergency service workers, school buses, public transportation, and tourists who use these roads
to either provide services or access coastal or mountain resources; and
WHEREAS, on January 29, 2013, both the Senate Committee on Public Safety,
Intergovernmental and Military Affairs, and the Senate Committee on Transportation and
International Affairs, recommended that Senate Bill No. 382 be passed, unamended; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
2013 Hawai`i State Legislature is hereby urged to pass legislation permitting the county of
Hawai`i to expend a portion of the county's share of fuel tax revenue for the maintenance of
substandard private subdivision roads which are used by the public.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable Governor Neil Abercrombie, the Honorable Senate President Donna
Mercado Kim, the Honorable Speaker of the House of Representative Joe Souki, the Honorable
Senator Gilbert Kahele, the Honorable Senator Russell Ruderman, the Honorable Senator Josh
Green, the Honorable Senator Malama Solomon, the Honorable Representative Mark
Nakashima, the Honorable Representative Clift Tsuji, the Honorable Representative Richard
Onishi, the Honorable Representative Faye Hanohano, the Honorable Representative Denny
Coffman, the Honorable Representative Nicole Lowen, the Honorable Representative Cindy
Evans, and the Honorable Mayor William P. Kenoi, and the Finance Director Nancy Crawford.
