Re: Department of Liquor Control Restoration Project

Transmitted herewith for Council's approval is a resolution authorizing the acquisition of
private property by eminent domain for the Department of Liquor Control Restoration Project
situated at Hilo Lagoon Centre, Hilo, Hawai`i, in accordance with Section 101-13, Hawai`i
Revised Statutes.
This resolution (Resolution 21-13, Comm. 28) was originally placed on the County
Council agenda for January 23, 2013; however, at the February 6, 2013 County Council meeting,
it was withdrawn by the introducer, Valerie Poindexter, Chair of the Committee on Finance, at
the request of Senior Deputy Corporation Counsel Joseph K. Kamelamela to allow the
Department of Liquor Control to amend the map (Resolution 21-13, Comm. 28.1).
Also attached are nine copies each of the map with the subject parcel to be acquired
highlighted.

RE: Resolution No. 63-13 : A Resolution Authorizing the Acquisition of Private
Property by Eminent Domain for the Department of Liquor Control Restoration Project
Situated at Hilo Lagoon Centre, Hilo, Hawai`i, in Accordance with Section 101-13,
Hawai`i Revised Statutes
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
