ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, SECTION 24-257
OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO
SPEED LIMITS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this measure is to lower the speed limit along Mamalahoa
Highway south of the Ala Ohia Road (Waimea bypass) intersection. With the subject speed limit
change, the design criteria specifically for the left-turn pocket into the Ala Ohia Road intersection
will be met within the existing right-of-way.
SECTION 2. Chapter 24, Article 10, Division 1, Section 24-257, Schedule 5. 35 mile
per hour limit, subsection (e), Kohala, of the Hawai`i County Code 1983 (2005 Edition, as amended),
is amended by revising existing item:
(1) Mamalahoa Highway (Highway 190), [in W a] from Lindsey Road to the end
of the County-maintained portion eighty-one feet south of Lalamilo Farm Road
[to a point four thousand feet in the Kona direction].
SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored.
In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be
included.
SECTION 4. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or application,
and to this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
