Your Committee on Public Works and Parks, to which was referred Communication No. 779, and attached
Resolution No. 257-00, reports as follows:
The purpose of Resolution No. 257-00 is to authorize the County, pursuant to section 23-10 of the Hawaii County
Code and article XIII, section 13-12 of the Hawaii County Chazter, to accept a dedication deed transmitting real
property fora 30 foot roadway easement lot adjacent to the Ahuli Pazk Subdivision, from the State of Hawaii. The
dedication deed is for a roadway lot located in Waimea, South Kohala, Hawaii, specifically identified as Tax Map
Key No: (3) 6-6-03:portion 007 (aka TMK: (3) 6-6-08:Road), as described in Land Patent Grant No. S-15,903.
Communication No. 779 is a letter from Deputy Corporation Counsel Gerald Takase, dated May 5, 2000, which
transmits Resolution No. 257-00 to the County Council for its review and consideration.
Glenn Toguchi, Executive Assistant to the Mayor, informed the Committee that this roadway is owned by the State
of Hawaii, and is currently being leased to the Waimea Outdoor Circle, which is used to access a private park at
Ahuli Pazk Subdivision. This 30-foot road reserve easement will allow access to Ahuli Park which the Waimea
Outdoor Circle plans to enhance the area with a nature park and education center.Although aprivately owned pazk, it
will be open to the public.
Chief Engineer Robert Yanabu informed the Committee that the road is asub-standard roadway, and that once the
roadway is dedicated over to the County of Hawaii, the County will be responsible for all liability of the roadway.
Council Members J. Curtis Tyler and Julie Jacobson voted kanalua times two.
Your Committee is in accord with the purpose and intent of Resolution No. 257-00 and recommends that it be
adopted.
