SUBJECT: Bill No. 21, Draft 3; REZ Waikoloa Mauka, LLC
Please find attached Bill No. 21, Draft 3. Bill No. 21, Draft 2, was amended by the contents of
Communication No. 67.4, as verbally amended by the Council and then duly approved at its meeting
on February 20, 2013.
The Council divided the question and voted on the amendments in Communication No. 67.4 in the
following manner:
1. Item 1, amending Condition C: approved amendments in lines four through eight;
amendments in lines 10-14 failed due to insufficient vote count; and approved
amendments in the last two lines;
2. Item 2, amending Condition D: approved; and
3. Item 3, amending Condition K: removed amendment changing "Two (2)" to
"Three (3)"; approved all other indicated amendments; and approved amendment that
added a sentence after the words "Planning Director" as appearing in line nine, relating
to subdivision of the first five-acre park site.
Subsequent to amending, the Council suspended its rule requiring holdover of substantively amended
legislation and voted to pass Bill No. 21, Draft 3, on second and final reading.
