A RESOLUTION REQUESTING THE LEGISLATIVE AUDITOR TO CONDUCT AN
AUDIT OF THE POLICE DEPARTMENT'S RECEIPT, STORAGE, AND DISPOSAL
OF EVIDENCE.
WHEREAS, the Police Department has the responsibility to obtain, store, and dispose of
evidence, prisoner property, and items found by police officers; and
WHEREAS, Section 3-18(d) of the Hawaii County Charter provides in part that the
Legislative Auditor shall conduct or cause to be conducted "Performance and/or financial audits
of the funds, programs, services, and operations of any county agency, executive agency, or
program, as set forth by the legislative auditor in an annual audit plan that shall be transmitted to
the county council and the mayor and filed with the county clerk as a public record."; and
WHEREAS, to promote public confidence and in an abundance of caution, an audit of
the Police Department's handling of evidence is appropriate to ensure that the retrieval, storage,
and disposition of evidence and confiscated property is being properly carried out; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Council hereby requests the Legislative Auditor to conduct an audit of the Police Department's
handling of evidence and confiscated property for the past three years.
BE IT FURTHER RESOLVED that the audit shall consist of, but not be limited to, the
following:
1. Ensuring that property is appropriately obtained, stored, transported, handled, and
disposed of,
2. An audit of the adequacy of the Police Department's internal management
control procedures and physical security of the property and evidence areas from
the point the evidence and confiscated property is identified to the final
disposition of the property and evidence; and
3. A performance audit to ensure the proper documentation of transactions and
events.
BE IT FURTHER RESOLVED that the Legislative Auditor shall conduct a physical
inventory of the property currently under the control of the Police Department with reference to
the associated police report or other relevant documentation of identified evidence and
confiscated property.
BE IT FURTHER RESOLVED that the Legislative Auditor may conduct further
examination into concerns that may arise during the course of the audit.
BE IT FURTHER RESOLVED that the Legislative Auditor shall complete the audit
within one year and submit its findings and recommendations to the Hawaii County Council, the
Honorable Mayor William P. Kenoi, Prosecuting Attorney Mitch Roth, and Police Chief Harry
S. Kubojiri.
BE IT FINALLY RESOLVED that the County Clerk shall forward copies of this
resolution to the Honorable Mayor William P. Kenoi, Prosecuting Attorney Mitch Roth, and
Police Chief Harry S. Kubojiri.
