Your Committee on Public Works and Parks, to which was referred Communication No.
564, and attached Bill No. 177, reports as follows:
The purpose of Bill No. 177 is to amend Chapter 21, Article 1, General Provisions, Section
21-2 (a)(22) and (24), of the Hawaii County Code by clarifying the definitions of public
sewer, sewage works, sewer, and sewer system. In addition, a new definition for "gang
cesspools" is to be added.
Communication No. 564 is from Council Member J. Curtis Tyler, III, dated
December 2, 1999, transmitting Bill No. 177 for the Council's review and consideration.
Your Committee first heard this measure on Mazch 24, 2000 at a Special Public Works and
Parks Committee meeting in Kona. Your Committee recommended that it pass first
reading and it was sent to Full Council for their review and consideration.
On April 19, 2000, Council referred Bill No. 177 back to the Committee o Public Works
& Parks for further discussion on this measure.
Communication No. 564.002 is from Council Member Bobby Jean Leithead-Todd
transmitting Bill No. 177, Draft 2 to amend Chapter 21, Article 1, General Provisions,
Section 21-2 (a)(22) and (24), of the Hawaii County Code by providing definitions for
cesspools, gang cesspools and adding a wastewater service charge rate for gang cesspools.
The new rate for gang cesspools would be $15.00 per month and the charges would be
billed bi-monthly.
Your Committee expressed concerns about what should be done about prior bills, both
paid and unpaid, under the $25.00 rate. Your Committee felt that those sewer charges
should not be applied and any fees paid should be reimbursed should this bill pass.
Language to effectuate this was proposed.

Your Committee is in accord with the purpose and intent of Bill No. 177 Draft 2, as
amended to Draft 3, and recommends that it pass first reading.
