RE: Palila, et. al. v. Hawaii Department of Land and Natural
Resources, et. al., CIV. NO. 78-0030 JMS
Request for executive meeting to discuss motion for
declaratory and injunctive relief regarding Hawaii County's
ordinance prohibiting aerial eradication
The Office of the Corporation Counsel respectfully requests the above
matter be placed on the March 28, 2013 agenda of the meeting of the Hawaii
County Council. We ask permission of the Council to discuss this matter in
closed executive session.
This request is made pursuant to Section 92-5(a)(4), Hawai'i Revised
Statutes, as amended (hereinafter "HRS"), and is made for the reason we
anticipate discussion on questions and issues pertaining to the Council's powers,
duties, privileges, immunities and liabilities with respect to Sections 14-111 and
14-112, Hawai'i County Code 1983 (2005 Ed.) (Ordinance No. 12-109).
