The Hawaii State Legislature passed the school impact fee law as Act 245, Session Laws of Hawaii 2007 which was subsequently amended by Act 188, Session Laws of Hawaii 2010. Under this law,the DOE can collect fees in school impact fee districts designated by the Board of Education(BOE) where new schools are required. The BOE has designated four impact districts: the West Hawaii Impact District,the West Maui Impact District,the Central Maui Impact District, and the Leeward Oahu Impact District. Under the impact fee law, school impact fees are tied to the county building permitting process. Pursuant to HRS 46-142.5,the relevant county is prohibited from issuing a residential building permit in a school impact district for new construction unless the DOE confirms that the applicant has satisfied its impact fee requirements. Collected fees must be used within the district for school lands and school facilities. The West Hawaii Impact District was adopted by the BOE on April 1561, 2010. Since then, the DOE has made several unsuccessful attempts to engage the County of Hawaii with regards to the implementation of the West Hawaii Impact District. The DOE would appreciate the County's cooperation in effectively instituting the West Hawaii Impact District in a manner that is least disruptive to the public and to County staff.
