We consider parking to be an accessory use to the primary use on a property. Without the primary use, you cannot just have accessory use. However, if the County were to acquire Ms. Tauro's property for parking purposes, that would be another story as public uses are permissible in all zoning areas. You'll recall that we own Mill Road and its shoulder. Yagong says he has had a complaint from the property owners who claim that the boulders are on their land and they want them removed. Delia Tauro, the owner living in Hilo, apparently says that she eventually plans to build a house. I'm not sure if this young woman ever lived in that house with her parents, and she may not realize how much trouble accompanies unattended parked cars especially on a dead end road. Please understand that I am getting this information third hand, but until I see a building permit, I am inclined to think this is an effort to provide unofficial parking for beach access. I think those in favor of eminent domain to take a public access that we built may be finding it hard to dredge up sufficient beach parking. The fear of residents here near the end of the road is that the lot will be cleared so that cars can park along the frontage and crowd into other areas beside and behind the house as they did for several years on the yard of a vacant house up the street on the Hamakua side of the Mill Road. Surfers used to park all over that property with sometimes as many as fourteen vehicles crammed onto the yard and the adjacent lane. The nearby neighbors to that lot finally got so fed up with the trash, foul language and public urination that they persuaded the owners of the property to fence it to prevent parking. Parking near the end of the road was always a chronic magnet for crime with frequent "smash and grab" thefts on cars, vandalism to our gate and locks and theft of any tools we might leave out on the land. Our purpose in lining the road shoulder with boulders was to prevent parking on the road shoulder and the associated crime which drifted onto our property from those cars on the road. It was also an effort to eliminate the congestion at the bottom and most narrow section of the road where cars block driveways, turn around in driveways and idle in the road while dropping off or waiting to pick up beach visitors. Williamson 1382 Ala Kula Street Hilo, HI 96720 Dear Ms. Tauro, Ms. Fleck, and Ms. Williamson: SUBJECT: Complaint-Portions of Property being cleared of Vegetation by Non- Owners for Alleged Use as a Parking Area TMK: 2-7-027: 012, Portion Papa`ikou, South Hilo,Hawaii On May 3, 2011, this office received a telephone complaint that the subject property is being cleared by person(s)who do not own the property for alleged use as a parking area. On May 5, 2011 our zoning inspectors conducted a site inspection of the subject property and observed that there is an abandoned and dilapidated single-family dwelling structure being engulfed by grasses and shrubs. Large cinder-type boulders have been placed on the front lawn area as a barrier. The property is accessed by Mill Road, which is a "private road" owned by the property owner of TMK: 2-7-004: 118. Mill Road is an existing narrow roadway that gives access to an old plantation housing area. This letter is to inform you that the subject property falls within the Special Management Area(SMA) which requires submission of an SMA Assessment Application to this office prior to conducting any (emphasis applied) activities. Currently we have not received any SMA Assessment Application informing us of the clearing of portions of your property. Please contact our Long Range Division Program Manager, Ms. April Surprenant, at (808) 961-8131 to discuss the alleged activities.
