SUBJECT: Proposed Amendments to Resolution No. 70-13
Please find attached proposed amendments to Resolution No. 70-13. The proposed
amendments are illustrated below in Ramseyer format with respect to the contents of
Resolution No. 70-13 and bolded for illustrative purposes.
The second WHEREAS clause is amended to read as follows:
"WHEREAS, County of Hawai`i Office of the Legislative Auditor wishes
to enter into [a ] a three (3) year lease with Martin Anderson, Kapoho
Properties, Inc., a Hawai`i corporation, Norman Piianaia, and Yamanaka
Enterprises, Inc., a Hawai`i corporation, for the use of Unit A-8, containing 1,755
square feet more or less, on the parcel identified as Tax Map Key: (3)2-2-001-
030, in Hilo, Hawai`i, (a.k.a. "Hilo Ironworks Building") for office space, at a
cost of$2,339.99 per month less the exemption of the parcel's real property taxes
under Section 19-84 of the Hawai`i County Code with a base rent increase after
the first [three (3)] two (2)years which shall be calculated by the sum of the past
three (3) years Consumer Price Index (Hawai`i Sector). The lease also contains
an option for renewal for an additional [five-(-5)] three (3) years with a base rent
determined by a market value assessment sixty (60) days prior to renewal date;
now, therefore,"

RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO
A MULTI-YEAR LEASE OF UNIT A-8, 1,755 SQUARE FEET MORE OR LESS,
BEING WITHIN ONE OF THE BUILDINGS SITUATED ON REAL PROPERTY
IN HILO, HAWAII, TAX MAP KEY: (3)2-2-001-030.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Section 10-11 of the Hawaii County Charter requires that any
contract, lease or other obligation requiring payment of funds from the appropriations of
a later fiscal year or of more than one fiscal year shall be approved by resolution; and
WHEREAS, County of Hawai`i Office of the Legislative Auditor wishes to enter
into a three (3) year lease with Martin Anderson, Kapoho Properties, Inc., a Hawai`i
corporation, Norman Piianaia, and Yamanaka Enterprises, Inc., a Hawai`i corporation,
for the use of Unit A-8, containing 1,755 square feet more or less, on the parcel identified
as Tax Map Key: (3)2-2-001-030, in Hilo, Hawai`i, (a.k.a. "Hilo Ironworks Building")
for office space, at a cost of$2,339.99 per month less the exemption of the parcel's real
property taxes under Section 19-84 of the Hawai`i County Code with a base rent increase
after the first two (2) years which shall be calculated by the sum of the past three (3)

BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that (1) the Mayor is hereby authorized to enter into a multi-year lease agreement for
office space for the Office of the Legislative Auditor as described herein, pursuant to
Section 10-11 of the Hawaii County Charter; and (2)that sufficient funds be budgeted in
future fiscal years to cover the anticipated obligations of the County under the lease
agreement.
BE IT FINALLY RESOLVED that a copy of this resolution be sent to: (1)
Mayor William P. Kenoi; (2) Legislative Auditor; (3) Assistant Corporation Counsel
Katherine A. Garson; (4) Finance Director Nancy Crawford; and (5) Yamanaka
Enterprises, Inc., 1266 Kamehameha Avenue, Hilo, Hawai`i 96720.
