Josepho, Et Al Tax Map Key 7-4-8:Por. 2 The Planning Commission, after a duly held public hearing on September 27, 1988 voted to recommend for your approval the proposed legislative bill to change the district classification for 0.778 acre of land from a Limited Industrial 1 -acre (ML -la) to a General Industrial 1 -acre (MG -la) at Kailua-Kona, Keahuolu, North Kona, Hawaii. The Commission concurs with the following Planning Director's reasons for initiating the change of zone: The requested change conforms to the General Plan Land Use Pattern Allocation Guide (LUPAG) Map which designates the area for Industrial uses. The requested General Industrial (MG) zoning will also complement the appropriate goals, policies, and standards of the General Plan. The Industrial Element of the General Plan states that there are ". . . two distinct types of industrial development. One sector is service oriented and is affected by population and the level of activity of other industries. The other sector is mostly influenced by outside markets. The location of industrial developments is important for many reasons. In the case of service types of industrial development (non -basic), areas designated for industrial uses must be close enough to population and/or commercial areas for efficiencies but still distant enough to avoid traffic and environmental problems. Both kinds of industries are affected by the availability of transportation facilities. Other factors equally important are the existence of public utilities, the cost of land, and internal and external circulation." The rezoning action merely make the zoning consistent with the adjacent lot (TMK: 7-4-15: 16) which the area under consideration will be consolidated with. Therefore, it can be concluded that this particular rezoning action is still necessary to accommodate present and future industrial growth and development of the Kona area. In light of the already established industrial land use pattern for this section of Kona, it is determined that the granting of this particular request will still provide for an orderly industrial development of the area. It will still accomplish the intent of the General Plan of centralizing industrial activities in given areas. The request would also conform to the locational standards of the Industrial Element of the General Plan which state that "Industrial development shall be conveniently located to its labor source," and "Industrial development shall be located in areas adequately served by transportation, utilities, and other amenities." The property is within close proximity to the major transportation facilities, such as the airport, as well as to the central commercial core and employment center of Kailua-Kona. All essential utilities and services are available to the area. It is therefore determined that the property also conforms to the location criteria for identifying industrial lands. It is further concluded that in granting this particular request, we would still be implementing the General Plan policies which states that "Through its zoning powers, the County shall locate industrial areas convenient to transportation facilities, and provide a variety of sizes of industrial sites, depending on the needs of the community." The property has no severe geologic or topographic problems which cannot be properly rectified or which would render the land unusable for the proposed use. As such, the request also complements the General Plan which states that the "Topography of industrial lands shall be reasonably level." It is further determined that the granting of the request would complement the General Plan goal of assuring the orderly Honorable Stephen K. The rezoning of this particular lot for its intended purpose would also complement the policies of the Economic and Industrial Elements of the General Plan which states that "It shall be the policy of the County to achieve a broader diversification of local industries by providing opportunities for new industries and strengthening existing industries." Based on the above, it is determined that the rezoning of the property to a General Industrial (MG) zoned district would still result in an appropriate land use pattern that will further the public necessity and convenience and the general welfare. For your favorable consideration, an amendment to Section 25-87, the North Kona Zone Map, of the County Zoning Code is transmitted. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section'25-87, Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, is amended to change the district classification of property described hereinafter as follows: The district classification of the following area situated at Keahuolu, North Kona, Hawaii, shall be General Industrial (MG -la): Beginning at the Northernmost corner of this portion of Parcel 2 of Tax Map Key 7-4-08, being also a point along the Southwesterly side of the existing open zoning designation, the coordinates of said point of beginning referred to Government Survey Triangulation Station "KAILUA (NORTH MERIDIAN)" being 2,394.75 feet North and 2,098.28 feet West and running by azimuths measured clockwise from True South: Thence, following along the existing open zoning designation and along the remainder of Royal Patent 6851, Land Commission Award 8452, Apana 12 to A. This change in district classification is conditioned upon the following: (A) the applicants, successors or assigns, shall comply with all of the stated conditions of approval; (B) the property shall be consolidated with TMK: 7-4-15:16 within one year from the effective date of the change of zone; (C) final Plan Approval shall be secured from the Planning Department within one year from the date of the receipt of final consolidation approval. To assure adequate -2- time for plan approval review and in accordance with Chapter 25-244 (Zoning Code), plans shall be submitted a minimum of forty-five days prior to the date by which plan approval must be secured. Parking shall comply with the requirements of Chapter 25 (Zoning Code). No parking variance from the Code shall be applied for or granted; (D) construction shall commence within one year from the date of receipt of Final Plan Approval and be completed within two years thereafter; (E) access(es) to the property shall meet with the approval of the Department of Public Works. No accesses shall be allowed from the Queen Kaahumanu Highway and Kaiwi Street; (F) a drainage system meeting with the requirements of the Department of Public Works shall be installed; (G) prior to any site work, an intensive archaeological survey shall be submitted to and approved by the Planning Department in consultation with the Department of Land and Natural Resources -Historic Sites Section and any mitigative measures shall be reviewed and approved by the Planning Department; (H) should any unanticipated sites be uncovered during grading of the property, work within the affected area shall cease. The Planning Department shall be notified and work within the affected area shall not resume until clearance has been obtained from the Planning Director; (I) the landowner shall donate to the State the additional right-of-way setback for future highway purposes (Queen Kaahumanu Highway) prior to receipt of subdivision approval; -3- (J) all other applicable laws, rules, regulations and requirements be complied with; (K) should the council adopt a Unified Impact Fees ordinance setting forth criteria for the imposition of exactions or the assessment of impact fees, conditions included herein may, at the developer's election, be satisfied by performance in accordance with the requirements of the Unified Impact Fees Ordinance; (L) an annual progress report shall be submitted to the Planning Director prior to the anniversary date of the effective date of the zone change. The report shall address the status of the development and the compliance with the conditions of approval. This condition shall remain in effect until all of the conditions of approval have been complied with and the Planning Director acknowledges that further reports are not required; and, (M) an initial extension of time for the performance of conditions within the ordinance may be granted by the Planning Director upon the following circumstances: 1) the non-performance i -s the result of conditions that could not have been foreseen or are beyond the.control of the applicants, successors or assigns, and that are not the result of their fault or negligence; 2) granting of the time extension would not be contrary to the general plan or zoning code; 3) granting of the time extension would not be contrary to the original reasons for the granting of the change of zone; and 4) the time extension granted shall be for a period not to exceed the period originally granted for -4- performance (i.e., a condition to be performed within one year may be extended for up to one additional year); and 5) if the applicant should require an additional extension of time, the Planning Director shall submit the applicant's request to the County Council for appropriate action. Further, should any of the conditions not be met or substantially complied with in a timely fashion, the Director may initiate rezoning of the area to its original or more appropriate designation. SECTION 3. In the event that any portion of the ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval. GENERAL INFOR,IATION 1. The area under consideration is owned by Liliuokalani Trust Estate. Marc Josepho and Roy Josepho currently 'Lease the property from the Trust. They, in turn, will transfer the lease to Banfe, Casper & Associates. PROPOSED DEVELOPMENT 2. The applicants intend to consolidate the area under consideration with an existing MG -la zoned lot, thus, creating a 3.4 -acre lot. At the same time, a portion of the existing MG -la zoned lot will be made a part of the Kaiwi Street extension. Therefore, the basic purpose for this request is to make the zoning of the entire lot consistent; namely, a MG -la zoning designation. 3. The proposal is to construct three new industrial warehouse buildings on the proposed 3.4 -acre lot. On October 30, 1980 (date of Decision and Order), at the request of the Trustees of the Liliuokalani Trust, the State Land Use Commission reclassified a 101 -acre area, including the area under consideration, from the State Land TIse Agricultural to the Urban District. 7. On February 10, 1984, the 101 -acre area was rezoned from an Unplanned (U) to a MJ, -la zoned district. The applicant's proposal contemplates simultaneous amendment of rezoning Ordinance Nos. 84-9 and 88-5 (which rezoned approximately 101.075 acres of TMK: 7-4-8:2 from Unplanned (U) to Open (0) and Limited Industrial (ML -la)) by deleting approximately 1+/- acre of the southeastern corner of Parcel 2 from Ordinance Nos. 84-9 and 88-5 and simultaneously rezoning that property to conform with the General Industrial (MG -la) zoning of adjacent Parcel 7-4-15:16. Both the existing General Industrial (MG -la) zoned area and the 1 -acre Limited Industrial (ML -la) properties have recently been rezoned in accordance with the County of Hawaii General Plan goals, policies, and courses of action. The requested General Industrial (MG -la) zoned district does conform with the General Plan Land Use Pattern Allocation Guide (LUPAG) map which designates the property for Industrial uses. The applicant has taken the preliminary steps toward setting aside 20 feet of the southern boundary of TMK Parcel 7-4-15:16 for purposes of dedication to the County of Hawaii in conjunction with the Kaiwi Street widening. The remainder of Parcel 16 will be consolidated with the 1+/- acre portion of Parcel 2 to create a new parcel. Simultaneously with the rezoning request, the applicant is processing a Special Management Area Use Permit application for the above properties to amend the SMA boundary line to coincide with the northern boundary of reconfigured TMK Parcel 7-4-15:16. The project proposal will maintain the 50 -foot Open (0) zoning for the future road widening of Queen Kaahumanu Highway pursuant to the prior rezoning actions. The draft Hawaii County General Plan (August 1987) states that there are 3,858 acres of industrially zoned lands in the County, 1,107 acres of which are vacant. The subject property is located within the existing Kona Industrial Subdivision and is immediately south of the Limited Industrial (ML -la) area recently rezoned by the County through Ordinance Nos. 84-9 and 88-5. As such, the proposed rezoning would conform with the existing industrial area which is serviced by adequate community facilities and utilities. The proposed rezoning will also facilitate industrial development in an area adequately -2- served by transportation, utilities and other amenities provided in the prior industrial rezoning for the surrounding properties. The agreement by the Liliuokalani Trust Estate to grant the additional land for the Kaiwi Street roadway widening will promote the General Plan objective of land development in concert with programmed public. and privately funded infrastructure to meet the industrial needs. At the present time, the market demand for industrial land within the Kailua-Kona region is strong, as evidenced by the fact that approximately 60% of the industrial spaces in this project have been tentatively committed. In light of the growing resort development in the South Kohala and North Kona areas, it is anticipated that demand for increased industrial space will remain strong. The projected market demand for industrial land which formed the basis for rezoning Ordinance Nos. 84-9 and 88-5 has materialized and continues to grow. Attached and incorporated herein as Exhibit "A" is the December 6, 1983 Planning Commission recommendation to the County Council in support of the industrial rezoning of TMK: (3) 7-4-08:por. 2, Ordinance Nos. 84-9 and 88-5, which clearly states the current justification for this rezoning request. The present proposal results from the request by the County of Hawaii Department of Public Works to provide approximately 20 lineal feet along the Kaiwi Street frontage of TMK 7-4-15:16 -3- for the purpose of road widening and eventual dedication to the County to alleviate the existing traffic access and congestion problem. Kona's demands for additional industrial lands are basically to provide for service-oriented or supportive industries. Within the Kona area, there are approximately 1,400 acres of industrial zoned lands, which include the Keahole Airport and Natural Energy Laboratory of Hawaii (NELH) areas and the existing Kona Industrial Subdivision. However, excluding the lands at Keahole Airport and NELH, only about 16 acres of industrial zoned lands are vacant of any uses.- Recently, ses. Recently, the Planning Commission recommended the approval of the rezoning of approximately 126 acres of land in the vicinity of the Honoxohau Small Boat Harbor to a similar ML -la zoned district. The proposal for tl:at area, however, is to create fee simple industrial lots. The property under consideration, however, will be marKeted on a leasehold basis. According to the 1980 Census figures, Kona is one of the fastest growing areas in the County of Hawaii in terms of population. We anticipate that this growth trend will continue in the years to come. As an area grows, there will be a demand for additional lands for industrial uses. Since tnese types of land are currently limited, it is determined that the granting of this particular request for its intended purposes is warranted to accommodate the present and future expansion of service-oriented industrial activities for the Kona area. Moreover, there will be further opportunities for industrial expansion with the development of the South Kohala resort destination areas. The development of these resort areas will require construction activity, as well as the normal operation of their facilities, both of which will require storage, wholesaling, and Dusiness and repair services, which could be supplied by Kona -based operations. It is therefore felt that the subject location for a potential industrial development could provide for the demand of additional industrial lands for present and future needs. In providing such lands for present and future industrial activities we would be in the direction of fulfilling some of the policies of the Economic and Industrial elements of the General Plan which basically state that "The County of Hawaii shall strive for diversification of its economy by strengthening existing industries and attracting new endeavors" and that "Tne I Honorable Stephen K. The granting of this particular request would also complement the specific course of action cf the Economic element which, in essence, states that the County hail explore the possibility of encouraging new industries in the Kona area. Based on the above, it is also felt that the provision of additional industrial -zoned lands is reasonably necessary to accommodate growth and development from an overall regional standpoint. It should be noted that the subject property is not located within any known potential flood hazard area. Therefore, the potential of damages from flood action should be minimal, if at all. Because of the distance of the subject area from the shoreline, the proposed development is not expected to have substantial adverse impact on the coastal ecosystem. Further, any visual impact the proposed development may create, these can be mitigated through existing regulations and further requirements or conditions of approval. As statea as a policy and standard of the Industrial el—Ement of the General Plan, "The County shall attempt to improve aesthetic quality of industrial sites and protect amenities of adjacent areas by requiring landscaping, open spaces, and buffer zones," and that "Buffer zones shall be established between industrial and adjacent non -compatible uses of land." Location -wise, the property will also provide a needed industrial expansion area adjacent to the existing Kona Industrial Subdivision. Therefore, from a localized, as well as from a regional standpoint, the proposed location would fit into the overall growth management plan for this sector or region of Kona. All essential utilities and services are or will be made available to the subject property. The transportation networks, which include the roadways, are also sufficiently adequate to accommodate the proposed development. As part of its development, the petitioner will De required to provide certain intersection improvements, including the construction of a channelized intersection with acceleration, deceleration, and left -turn storage lanes at the Queen Kaanumanu Highway. It is felt tnat with the provision of these roadwav improvements, the goals of the Transportation element of the General Plan which states to "Provide a transportation system whereby people and Honorable Stephen and Members of the Page 4 R.
