Yamashiro, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, Hawaii 96720 Dear Chairman Yamashiro and Members : Rezoning Request - Glenmore Trust Investment Tax Map Key 7-5-22 :43 and 44 The Planning Commission, after a duly held public hearing on August 30, 1988 voted to recommend for your approval the proposed legislative bill to change the district classification for 15,054 square feet of land from a Multiple Family Residential - 1,000 square foot (RM-1) to a Village Commercial - 7, 500 square foot (CV-7 . 5) zoned district at Kailua Village, North Kona, Hawaii. The Commission concurs with the following Planning Director' s reasons for initiating the change of zone: The Land Use Pattern Allocation Guide Map (LUPAG) component of the General Plan is a representation of the document' s goals, policies, standards , and courses of actions. It is also a graphic depiction of the physical relationships among the various land uses. The LUPAG map establishes the basic land use pattern for areas within the County. The LUPAG map designates the property for Medium Density Urban Development. Such a designation may allow commercial uses. An evaluative corollary to the LUPAG map is the policy analysis approach. In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better Comm. No. / 791/ File No. ZNGMA, Ref. Yamashiro, Chairman and Members of the County Council Page 2 time and stage developments to achieve growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must also be considered as they may have an impact on similar areas in the County. The requested change of zone conforms to the General Plan Land Use Pattern Allocation Guide (LUPAG) Map which designates the area for Medium Density Urban Development. Such a designation may allow Village and Neighborhood commercial uses. For the Kailua Village Special District area, the LUPAG Map provides for the concentration of urban activities with development occurring in an orderly manner commensurate with the provision of the necessary infrastructure. The General Plan LUPAG map has designated the High Density and Medium Density core to extend from Palani Road south to Lunapule Road and from Kuakini Highway up to the Queen Kaahumanu Highway. The property is within this established core area and as such is in close proximity to Kailua Village and other commercial retail activities in the area. It is therefore determined that the request is consistent with the urban form depicted on the LUPAG Map as the area would be an extension of the established commercial core for the village of Kailua. In order to accommodate the demand additional commercial land, other zoned areas within the designated medium density core must be considered. However, such expansion should occur in conformance with the General Plan Land Use pattern as discussed previously. Since this property is within the area earmarked for medium density urban uses, it is determined the request will help to provide adequate commercial areas for the needs of Kailua Village in a concentrated manner consistent with the goals, policies and land use pattern expressed in the General Plan. The request would be consistent with the urban form depicted for Kailua Village in that it would add commercial uses serving the entire village in a central location and in close proximity to other similar services. Thus, the approval of the request is anticipated to strengthen the existing commercial core in addition to providing services to the community. In this regard the approval of the subject request would be consistent with the General Plan Commercial Policy which states that the "Distribution of commercial areas shall be such as to best meet the demands of neighborhood, community and regional needs. Yamashiro, Chairman and Members of the County Council Page 3 The Kona Regional Plan and the Kailua Village Design Plan is intended to provide short and middle range implementation strategies for the goals, policies, and land use pattern presented in the General Plan. While the land use maps for these documents suggests that the area be designated for General Commercial and Residential uses respectively, it also recognizes basic problems associated with the existing commercial development. One is the potential growth of the West Hawaii district with the major resort developments in the South Kohala and North Kona districts and the commercial needs to be created by this growth. The necessity of providing areas which will support the commercial needs have to be addressed. In anticipation of this, the General Plan recognized that it was necessary to designate specific areas in which this anticipated development would occur. The proposed change of zone would be implementing the General Plan with respect to this premise. Therefore, we have determined that the properties are within this designated commercial core of Kailua Village. The Kona Regional Plan which was adopted in 1984 stated that "It should be clearly noted that the Kona Regional Plan is intended to be used as a guide to help the nature of future land use actions by both the public and private sectors. It is not, however, intended to function in a regulatory manner mandating compliance. While it assists in making zoning decisions, it is not the zoning map. " Although the Kona Regional Plan and the Kailua Village Design Plan which were adopted in 1984 and 1976 respectively by the Planning Commission suggest that area for general commercial and residential uses, it is felt that the area in question is compatible to be used for the uses within the Medium Density category. The inclusion of this area with the requested Commercial zoning would therefore not exclude any residential development of this area but is anticipated to be compatible with its surrounding residential development. Therefore, the requested change of zone would still complement the goals and policies of the General Plan and both plans as it will tend to concentrate commercial developments as well as be compatible with existing residential developments in the Kailua Village area. The Commercial element of the General Plan also states that commercial facilities shall be developed in areas adequately served with essential services such as water, other utilities, and transportation systems. The area is provided with all of these essential utilities. A condition Honorable Stephen K. Yamashiro, Chairman and Members of the County Council Page 4 of the change of zone will be for the petitioner to provide all of the necessary curb, gutter, sidewalk and pavement improvements along the frontage of the subject property. Thus, with the provision of these essential infrastructure, it is determined that the request also complements this policy of the General Plan. Based on the above reasons, it is determined the granting of this request would result in an appropriate land use pattern that will further the public necessity and convenience and the general welfare. For your favorable consideration, an amendment to Section 25-89, the Kailua Urban Zone Map, of the County Zoning Code is transmitted. This change in district classification is conditioned upon the following: (A) the applicant, successors or assigns shall comply with all of the stated conditions of approval; (B) submit an application for the consolidation of the subject properties within one year of the effective date of approval of the Change of Zone; ( C) plans for the proposed office building and related improvements , including landscaping, shall be submitted for Plan Approval review within one year from the date of consolidation approval; -2- (D) construct-ion shall commence within one year from the date of receipt of Final Plan Approval and be completed within two years thereafter; (E ) a drainage system shall be installed in accordance with the requirements of the Department of Public Works; (F) curbs, gutters, and sidewalks shall be provided along Kalani and Kalawa Streets meeting with the approval of the Department of Public Works . The plans for these improvements shall be submitted to the Planning Director and the Chief Engineer simultaneously with the submission of development plans for final Plan Approval . These improvements shall be constructed in accordance with the standards of the Department of Public Works prior to issuance of the certificate of occupancy; (G) should any unidentified sites or remains, such as artifacts, shell , bone or charcoal deposits, human burials, rock or coral alignments, paving or walls be encountered, work in the area affected shall cease and the Planning Department immediately notified. Subsequent work shall proceed upon an archaeological clearance from the Planning Department when it finds that sufficient mitigating measures have been taken; ( H) all applicable County and State laws, rules , regulations and requirements shall be complied with; ( I ) should the Council adopt a Unified Impact Fees ordinance setting forth criteria for the imposition of exactions or the assessment of impact fees, conditions included herein may, at the developer ' s election, be satisfied by performance in accordance with the requirements of the Unified -3- • Impact Fees Ordinance; (J) an annual progress report shall be submitted to the Planning Director prior to the anniversary date of the effective date of zone change. The report shall address the status of the development and the compliance with the conditions of approval . This condition shall remain in effect until all of the conditions of approval have been complied with and the Planning Director acknowledges that further reports are not required; and (K) an initial extension of time for the performance of conditions within the ordinance may be granted by the Planning Director upon the following circumstances : a ) the non-performance is the result of conditions that could not have been foreseen or are beyond the control of the applicants, successors or assigns, and that are not the result of their fault or negligence; b) granting of the time extension would not be contrary to the general plan or zoning code; c) granting of the time extension would not be contrary to the original reasons for the granting of the change of zone; d) the time extension granted shall be for a period not to exceed the period originally granted for performance ( i .e. , a condition to be performed within one year may be extended for up to one additional year) ; and e ) if the applicant should require an additional extension of time, the Planning Director shall submit the applicant ' s request to the County Council for appropriate action. Further, should any of the conditions not be met or substantially complied with in a timely fashion, the Director may initiate rezoning of the area to its original or more appropriate designation. -4- SECTION 3. In the event that any portion of the ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4 . This ordinance shall take effect upon its approval. The property is situated only one block off Kuakini on the corner of Kalani Street and Kalawa Street. Kalani Street meets Kuakini at a signalized intersection, creating a preferred traffic situation. Honolulu Federal Savings and Loan lies across Kalawa Street adjacent to the West. Diagonally across the Kalawa Street, Kalani Street interest is a McDonald's restaurant. Office and other commercial uses, including the County offices are situated between Kalawa Street and Kuakini Highway, making the subject vacant property a natural extension of the commercial office area 2. The change of zone is consistent with the goals of allocating land uses in approriate proportions to need. The increased business activity in West Hawaii which has been generated by the existing resort industry growth, the alternate energy explorations, the astronomical activity and the ocean technology industry. The property is located on the north-east corner of the Kalawa Street-Kalani Street intersection in the Lono Kona Subdivision, Kailua Village, North Kona, Hawaii-, TMK: 7-5-22 : 43 and 44 . PROPOSED DEVELOPMENT 1. The petitioner is requesting the change of zone to allow the construction of a new two story office building of approximately 8, 316 square feet (1st floor - 2,702 s. f. ; 2nd floor - 5, 614 s .f. ) . 2 . An off-street parking area for 26 cars will be provided with landscaping. 3 . The petitioner is also proposing to construct curb, gutter and sidewalk improvements along the entire frontage of the property along Kalawa and Kalani Street. 4 .
