From Mayor William Kenoi, dated March 22, 2013, transmitting the above bill and
enclosures with a favorable recommendation from the Windward and Leeward Planning
Commissions. Amends sections 25 -6 -1, Purpose; 25 -6 -3, Application for P.U.D.;
25 -6 -4, Notice of action on P.U.D. application; 25 -6 -5, Procedure for processing
application when use not permitted in district; and 25 -6 -6, Actions by director on P.U.D.
permit applications; adds section 25 -6 -7, Community meeting required prior to
submittal of an application for a P.U.D.; amends sections 25 -6 -10, Criteria for granting
a P.U.D. permit; 25 -6 -11, Height exceptions authorized; 25 -6 -12, Approval of
variances, use permits and plan approvals issued under P.U.D. permit; 25 -6 -13, Effect
of P.U.D. permit on other zoning provisions; 25 -6 -14, Time extension and amendments;
and 25 -6 -15, Appeals.

confirmation.
UNFINISHED BUSINESS:
Comm. 824: AMENDS CHAPTER 25, ARTICLE 6, DIVISION I OF THE HAWAII COUNTY
(Bill 291) CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO THE PLANNED
UNIT DEVELOPMENT (P.U.D.)
Amends section 25-6-1, Purpose; deletes section 25-6-2, Minimum land area required,
amends sections 25 -6 -3, Application for P.U.D. permit; requirements; amends 25-6-4,
Notice of action on P.U.D. application; deletes section 25-6-5, Procedure for
processing application when use not permitted in district; amends section 25-6-6,
Actions by director on P.U.D. permit applications and replaces it with Procedure for
processing P.U.D. application; adds section 25-6-7, Conditions imposed on P.U.D.; and
section 25-6-8, Review and approval of final site plans; deletes section 25-6-10,
Criteria for granting a P.U.D. permit; replaces sections 25-6-11, Height exceptions
authorized with Construction in conformity with approved final site plans; replaces
25-6-12, Approval of variances, use permits and plan approvals issued under P.U.D.
permit with Plan approval issued by approval of final site plans; amends sections
25-6-13, Effect of P.U.D. permit on other zoning provisions; 25-6-14, Time extension
and amendments; and 25-6-15, Appeals.

Submitting Written Testimony: Those submitting written testimony at the meeting should bring fourteen
(14) copies for distribution. Public testimony may also be submitted before 12:00 noon on the business
day prior to the meeting (1) by mail to the County Clerk's Office in Hilo at 25 Aupuni St., Hilo, Hawaii,
96720; (2) by facsimile to (808) 961 -8912; or (3) by e -mail to counciltestimony@co .hawaii.hi.us. Please
submit separate testimony for each item.
Submitting Video Testimony: Those submitting video testimony may email a complete web address (url)
to videotestimony hawaiicounty.gov before 12:00 noon on the business day prior to the meeting. The
email shall indicate the appropriate Committee or Council meeting, the meeting date, agenda item
(communication, bill, resolution, or report number), and number of testifiers on the video submittal. Each
video submittal shall be limited to a single agenda item. Video submittals may contain up to three
individual testifiers and shall each be up to three minutes in length. Video testimony will not be played
during the meeting; however, it will be distributed to Council Members prior to the meeting. The Office of
the County Clerk reserves the right to refuse testimony containing inappropriate content or that is not in
compliance with Council Rule 13 (Public Statements and Testimony).
