Re: Resolution to Accept Lease Agreement for Real Property
The County of Hawai`i owns lands in the District of Hamakua, County and State of Hawai`i
identified by tax map (3) 4-3-009-59. Resolution 38-11 authorized the lease of certain County of
Hawai`i owned lands, of which these parcels are included, and required that the negotiated lease
agreement for those lands be accepted by the County Council pursuant to
Section 2-114(d) of the Hawai`i County Code.
Enclosed is a resolution presenting the negotiated agreement between Frank Commendador and the
County of Hawai`i the County Council pursuant to Resolution 38-11 so that it may be accepted in
accordance with Section 2-114(d) of the Hawai`i County Code.

A. REQUEST:
PREPARE A COUNTY COUNCIL SUBMITTAL TO NEGOTIATE A LEASE AGREEMENT FOR HAMAKUA
LANDS IDENTIFIED AS TAX MAP KEY (3) 4-3-009-059 with Frank Commendador, PURSUANT TO
SECTION 2-114 OF THE HAWAII COUNTY CODE.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The County of Hawaii owns lands in the District of Hamakua, County and State of Hawaii including those
identified by tax map key (3) 4-3-009-059. Resolution 38-11 authorized the lease of certain County of
Hawaii owned lands, which includes these parcels, and required that the negotiated lease agreement for
those lands be accepted by the County Council pursuant to Section 2-114(d) of the Hawaii County Code.
Attached is the negotiated agreement between Frank Commendador and the County of Hawaii to submit to the
County Council pursuant to Resolution 38-11 so that it may be accepted in accordance with Section 2-114(d)
of the Hawaii County Code.
