ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 8, SECTION 24-293
OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO
RESTRICTION ON CERTAIN VEHICLES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this measure is to revise the Hawai`i County Code in accordance
with the Mamalahoa Highway Bypass Road project.
SECTION 2. Chapter 24, Article 10, Division 8, Section 24-293, Schedule 41. Use of certain
streets by certain vehicles restricted, subsection (f), under paragraph (1), of the Hawai`i County Code
1983 (2005 Edition, as amended), is amended by deleting existing items and renumbering as appropriate:
[(D) Mamalahoa Bypass Highway, in the North Kona District.]
[(€)- Mamalahoa Bypass Highway, in the South Kona District.]
SECTION 3. Chapter 24. Article 10, Division 8, Section 24-293, Schedule 41. Use of certain
streets by certain vehicles restricted, subsection (f), under paragraph (3), of the Hawai`i County Code
1983 (2005 Edition, as amended), is amended by deleting existing items:
[(A) Haleki`i Street in the South Kona District, from the Mamalahoa Bypass Highway to a
point four thousand feet in the easterly direction.]
[(B) Mamalahoa Bypass Highway in the North Kona District.]
[(C) Mamalahoa Bypass Highway in the South Kona District.]
SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored.
In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be
included.
SECTION 5. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or application,
and to this end, the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
