Re: Operating Budget
Pursuant to Section 10-15 of the County Charter, 2% of real property tax revenues (including
penalty and interest) must be transferred from the General Fund to the Public Access/Open
Space, and Natural Resources Preservation(PONC) Fund. Real property tax interest revenues
are expected to exceed the amount budgeted for FY 2012-13, requiring additional funds be
transferred into the PONC account in order to maintain compliance.
Enclosed is a bill for an Ordinance amending the Operating Budget by appropriating $290,000 to
the Public Access/Open Space, and Natural Resources Preservation Fund.
In order to ensure that the transfer may be done by the deadline as required by the County
Charter, we are requesting that this bill be waived from the Finance Committee and be placed on
the May 15, 2013 Council agenda.

A. REQUEST:
To amend the FY13 General Fund operating budget by increasing revenues and appropriations by the
following:
Increase Real Property Taxes Interest estimated revenues by $290,000
Increase appropriation Transfer to Public Access/Open Space Preservation Fund by $290,000
We are asking that the Finance Committee be waived to ensure that the transfers are done on time.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Real property tax interest revenues are expected to exceed the amount budgeted, which would then cause
the budgeted appropriation for the transfer to the Public Access/Open Space Preservation Fund to be
insufficient.

RE: Bill No. 72 : An Ordinance to Amend Ordinance No. 12-86, as Amended, the
Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2013
Relating to the Transfer of Funds to the Public Access, Open Space and Natural Resources
Preservation Fund.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
