Re: Operating Budget
Enclosed is a bill for an ordinance amending the Operating Budget by appropriating
$222,300 from the Liquor Control Fund Balance Reserve Account to the Department of
Liquor Control's Other Current Expenses (OCE) account.
In accordance with Section 101-13, Hawai`i Revised Statutes, Resolution 21-13 authorized
the acquisition of private property by eminent domain. This property, identified by Tax
Map Key(3) 2-2-014-010:0557 (POR), Suite 229B, situated at Hilo Lagoon Centre will be
renovated and made ADA compliant for the Department of Liquor Control for use as a
conference room. Fair market value, as determined by a certified real estate appraiser, is
$222,300, which must be deposited with the 3rd Circuit Court at the time of filing of the
complaint in order to take immediate possession of the property.
The Department of Liquor Control requests that this bill be waived from the Finance
Committee in order to meet the deadline to file the required documents with the 3rd Circuit
Court, and be placed on the May 15, 2013 Council Agenda.

A. REQUEST:
The Dept. of Liquor Control requests to transfer the following:
From: Liquor Control Fund Balance Reserve Account =$222,300.00
To: 010.251.5251.02.229 (Bldg & Constr Materials) = $222,300.00
We also request to waive committee. Documents will be filed in court within the next 2 weeks. Funds must
accompany the documents.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
In accordance with Section 101-13, Hawaii Revised Statutes, Resolution 21-13 authorized the acquisition of

Lagoon Centre for the Dept. of Liquor Control for the renovation of the Liquor Conference Room to be ADA

amount must be deposited with the 3`d Circuit Court at the time of filing of the complaint in order to take

RE: Bill No. 77 : An Ordinance to Amend Ordinance No. 12-86, as Amended,the
Operating Budget for the County of Hawai`i for the Fiscal Year Ending June 30, 2013.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
