SUBJECT: Proposed Amendments to Resolution No. 106-13, Draft 2; A Resolution
Accepting the Negotiated Lease Agreement for Hamakua Lands Identified as
Tax Map Key (3) 4-3-009-059 with Frank Commendador, Pursuant to Section
2-114 of the Hawai`i County Code
Please see below proposed amendments to Resolution No. 106-13, Draft 2, to conform the
reference to the lease agreement (now labeled "Exhibit "A" Draft 2") to its corresponding
references within the resolution. The amendments are illustrated by Ramseyer format (material to
be added is underscored).
1. Resolution No. 106-13, Draft 2, is amended by amending the third WHEREAS clause to
read as follows:
"WHEREAS, the negotiated lease agreement with Frank Commendador attached hereto as
Exhibit "A" Draft 2 for Tax Map Key (3) 4-3-009-059 is presented to the County Council pursuant
to Resolution 38-11; and"
2. Resolution No. 106-13, Draft 2, is amended by amending the enacting clause to read as
follows:
"BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
negotiated lease of Tax Map Key (3) 4-3-009-059 to Frank Commendador under the terms and
conditions as noted in the Lease attached hereto as Exhibit"A" Draft 2 is hereby accepted."
In an effort to conserve resources, a draft copy of Resolution No. 106-13, Draft 3, has not
been attached.
