HomeMy WebLinkAboutRES 387 Draft 01 1962 COUNTY OF HAWAII - STATE OF HAWAII RESOLUTION NO. 387 WHEREAS, Section 260-18, Revised Laws of Hawaii 1955, provides in part that "any government physician designated by the coroner in the counties of Hawaii, Maui and Kauai, shall be the coroner' s physician for such county" ; and WHEREAS, prior to the Attorney General' s memorandum, dated February 6, 1961, the term "government physician" was used in reference to state employed physician as distinguished from county employed physician who was referred to as "county physician" ; and WHEREAS, said memorandum stated that " ' any government physician' referred to in Chapter 260-18 implies a physician who is employed by the county government to act as coroner' s physician" ; and WHEREAS, the memorandum is contrary to the long established usage of the term "government physician" ; and WHEREAS, the memorandum of February 6, 1961, will work a hardship on the county and the police department when autopsies are necessary because county employed physicians are not available in every district; and WHEREAS, on the other hand, state employed physicians are available in every district. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS in and for the County of Hawaii that the Legislature of the State of Hawaii be and is hereby respectfully requested to amend Section 260-18, Revised n•'f '.T ,� Xt�' No .._ ... .«., :,,::,• JAN 1.6 1962 Laws of Hawaii 1955, by clarifying the term "government physician" to mean state employed physician. BE IT FURTHER RESOLVED that the County Clerk be and is hereby directed to forward copies of this resolution to the Honorable William H. Hill, President of the Senate, the Honorable Elmer F. Cravalho, Speaker of the House, and to all the members of the Legislature from the County of Hawaii.
