Your Committee on Public Works and Parks, to which was referred Communication
No. 896, and attached Resolution No. 314-00, reports as follows:
The purpose of Resolution No. 314-00 is to authorize the Chief Engineer to issue permits
for the installation of convex mirrors within the County right-of--way. Permits will be
issued to individuals who have exhausted all other means to improve sight distance at their
private driveway.
Communication No. 896 is from Deputy Chief Engineer Jiro A. Sumada, dated
August 15, 2000, transmitting Resolution No. 314-00, for the Council's review and
consideration. Mr. Sumada states that there has been an increased use of convex mirrors
along the State Highway, and individuals have been requesting permission to install
convex mirrors within County streets. This resolution will allow the Department of Public
Works to respond to such requests.
Your Committee expressed concerns regarding the Convex Mirror Installation Permit
which is attached to Resolution No. 314-00 as Exhibit A. The measure states that the
Permittee shall be responsible for installation, proper alignment, and maintenance of the
minor. Further, it states that the Permittee agrees to hold harmless, indemnify and defend
the County of Hawaii, its officers, employees and agents against all lawsuits, claims,
demands, judgments, liens or costs arising from the placement of the convex mirror within
the County's right-of--way.
Mr. Galen Kuba, Department of Public Works Engineer Division Chief informed Your
Committee that the language in this measure is to insure that the applicant will use this
resolution as a last resort after all other avenues have been exhausted.

Deputy Corporation Counsel Scott Leithead commented that this measure is a program
which would allow the Department of Public Works an avenue to address the requests for
convex mirrors. Mr. Leithead stated that this program should be flexible in the event
changes need to be made in the future.
Your Committee made motion to amend item number 5 of Exhibit A by deleting the words
"even if', and replacing it with the word "unless". Further amendment was made in item
number 6 of Exhibit A by deleting the words "new or."
Council Member J. Curtis Tyler, III's motion to propose an amendment to item number 8
in Exhibit A, to inform the Permittee that the permit may be subject to other restrictions,
conditions, and terms which will best serve the interest of the County and the general
public, was carried.
Your Committee is in accord with the purpose and intent of Resolution No. 314-00,
as amended to Draft 2, and recommend its adoption.
