HomeMy WebLinkAboutREP PWPRC 023 2013/05/14 2012-1014 REPORT OF THE COMMITTEE ON PUBLIC WORKS AND PARKS AND RECREATION REGARDING: Communication No 256/Bill No. 69 DATE: May 14, 2013 LOCATION: Council Chambers, Hilo, Hawai TITLE: An ordinance amending Chapter 14, Article 1, Section 14-1, of the Hawaii County Code 1983 (2005 Edition, as amended), relating to intoxicating liquors prohibited in certain public places. EXPLANATION: Your committee on Public Works and Recreation, to which was referred Bill No. 61, reports as follows: Bill No. 69, transmitted by council member Karen Eoff, via Communication No. 256, dated April, 19, 2013, amends Chapter 14, Article 1, Section 14-1, of the Hawai`i County Code 1983 (2005 Edition, as amended) relating to intoxicating liquors prohibited in certain public places. The purpose of the amendment is to prohibit intoxicating liquors from county parking lots and facilities including landscaping strips, stairwells and pedestrian passageways, internal roadways and roadways for ingress to and egress from such parking lot or facility. Your committee received testimonies in support of this measure from the Kailua Village Business Improvement District (KVBID) executive director Debbie Baker and board member Jim Moore, deputy prosecuting attorney Debbie Lawson, South Hilo Police Captain Robert Wagner and Mr. Gill Robinson. All testifiers agree that this amendment will clarify ambiguity and help enforcement of the statute by identifying specific areas where intoxicating liquors are prohibited. Council member Karen Eoff stated that the existing ordinance does not include the specific areas sought to be added on the amendment . This measure will correct a loophole in the current law and would be applicable to the whole island. AMENDMENTS: Comm. No. Introducer Approved/Disapproved None PWPRC Rept.
