RESOLUTION NO. 121 13
RESOLUTION AUTHORIZING A GRANT OF EASEMENT FOR UTILITY PURPOSES TO
HAWAII ELECTRIC LIGHT COMPANY, INC., OVER TAX MAP KEY (3) 2-2-015:033
(POR.)
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the Hawaii Electric Light Company, Inc., ("HELCO")plans to improve its
transmission capability to the Kaiko`o area of South Hilo County and State of Hawai`i; and
WHEREAS, the County of Hawai`i ("County") owns the parcel Tax Map Key (3) 2-2-015:033
where an existing HELCO unit is in place; and
WHEREAS, HELCO requested an easement from the County of Hawai`i that will allow for
additional equipment to be stationed there as described in Exhibit"A"; and
WHEREAS, the Departments of the County of Hawai`i have stated no objections to this
easement being granted; and
WHEREAS, the independent appraisal valued this easement at FIVE THOUSAND FOUR
HUNDRED AND 00/100 DOLLARS ($5,400.00); and
WHEREAS, pursuant to Sections 2-111(2) and 2-112, Hawai`i County Code, the Council is
authorized to grant easements, subject to reverter to the County of Hawai`i upon termination or
abandonment of the specific purpose without auction upon a finding of substantial purpose; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the
Finance Director is hereby authorized to negotiate a grant of easement to HELCO pursuant to Chapter
2, Article 19, Hawai`i County Code, across parcel Tax Map Key (3) 2-2-015:033 (por.), as described in

Exhibit"A", and that such grant of easement is subject to reversion to the County of Hawai`i upon its
termination or abandonment.
BE IT FURTHER RESOLVED that the Council of the County of Hawaii finds substantial
purpose in granting HELCO this easement without auction given the easement is to include existing
and additional areas for HELCO across parcel Tax Map Key (3) 2-2-015:033 (por.).
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to
(1) Mayor William Kenoi; (2)Nancy Crawford, Director of Finance; (3) Warren Lee, Director of
Public Works; (4) Deputy Corporation Counsel Craig Masuda; and (5) Wayne A. Nakamura, Land
Agent, Hawaii Electric Light Company, Inc., P. O. Box 1027 Hilo, Hawai`i 96721.
