Subject: RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC
SEWER FROM KEANALEHU DRIVE THRU THE PROPOSED PHASE 1 —
`AKAU DEVELOPMENT OF THE LA'I'OPUA VILLAGE 4 SUBDIVISION
WITHIN TAX MAP KEYS 7-4-021:010 & PORTION OF 7-4-021:012,
SITUATED IN KEALAKEHE, NORTH KONA, HAWAI'I FOR THE
DEPARTMENT OF HAWAIIAN HOME LANDS
Dear Chair Yoshimoto and Council Members,
Enclosed for your review and consideration in accordance with Section 21-26.1 of the Hawai'i
County Code, is the proposed resolution authorizing the extension of the public sewer system to
provide service for the proposed Phase 1 — `Akau development of the La'i'opua Village 4
Subdivision. An approved Application for Sewer Extension and Location Map are enclosed as
supporting documentation.
The initial phase of the project is to serve Tax Map Keys (TMKs) 7-4-021:010 and a portion of
TMK 7-4-021:012 which is owned and developed by the Department of Hawaiian Home Lands
(DHHL). The Applicant elects to construct the proposed extension and bear the total cost of the
installation and requests reimbursement for the cost of the sewer extension in accordance with
Section 21-28(a), Hawai'i County Code.
The initial phase of the work involves installation of sewer infrastructure within the proposed road
right-of-ways and connection to the public sewer system via existing stubouts at the Keanalehu
Drive—Maua Place and Keanalehu Drive—Ko'oko'olau Street intersections. The sewer extension
serving the Phase 1 development will permit the wastewater generated from this phase of the
subdivision to be treated at the County's Kealakehe Wastewater Treatment Plant. The sewer
extension within Phase 1 will allow a future sewer extension of the Phase 2 —Hema development
via a stubout at the Ohemakai - Ko'oko'olau Street intersection which will require approval by a
separate resolution. /��

Section 21-27, Hawai'i County Code states that the landowner shall not have any interest in the
extension. In this case, the extension, if approved, will be built within road right-of-ways which
will be dedicated to the County by a separate resolution. For clarity and completeness the road
dedication will also reference the transfer of the sewer extension to the County.
