AN ORDINANCE AMENDING ORDINANCE NO. 88 -81, AS AMENDED, RELATING TO
PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR
JULY 1, 1988, TO JUNE 30, 1989.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. Resolution 397 -88, adopted by the
Hawaii County Council on March 15, 1988, increased the County
fuel tax by 3.8 cents per gallon, and provided that all
additional revenues generated as a result of the increase shall
be expended for highway improvements as delineated in Exhibit A
of the resolution. The exhibit sets forth the manner by which
the funds generated by the fuel tax increase would be
appropriated among various public works projects over the next
ten years. These projects were placed in one of five
increments, depending upon the order of priority, with each
increment covering two fiscal years. The projects included
within the first increment, Increment I, were incorporated into
the capital budget for the fiscal year July 1, 1987, to June 30,
1988, by virtue of Ordinance No. 88-78,-and construction of
those projects have either commenced or are scheduled to
commence before June 30, 1989.
The chief engineer has now determined that a
reprioritization of the scheduled projects included within
Increments I and II is desirable in order to satisfy changing
community demands. The changes shall result in an interchanging
of projects between the two increments and are, relative to
Increment I, as follows:

Channelized Intersection
The council concurs with the determination of the chief
engineer and finds that such a reprioritization is in the best
interest of the County. However, the council also recognizes
that inasmuch as amending the budget of a previous year is
improper, the deletion of those items from Increment I may not
be done by amending the capital budget for fiscal year July 1,
1987, to June 30, 1988. Instead, the council shall accept the
declaration of the chief engineer that those projects sought -to
be deleted shall not be undertaken this fiscal year, but shall
be added to the list of projects included in Increment II and

incorporated into the capital budget for fiscal year July 1,
1989, to June 30, 1990. In addition, the council determines
that the cost estimates for those projects desired now to be
included within the first increment may be inadequate and deems
it necessary to increase those amounts by ten percent to enable
the County to sufficiently meet any and all cost demands
required for the effective completion of such projects.
Finally, the council finds that the revenues generated by the
fuel tax increase are sufficient to justify the appropriations
necessary to allow for those projects reprioritized from
Increment II to Increment I.
SECTION 2. Ordinance No. 88 -81, relating to public
improvements and financing thereof for the fiscal year July 1,
1988, to June 30, 1989, is hereby amended by adding the
following projects:

SECTION 3. Funds for these projects shall be provided from
that portion of the Highway Fund which is designated as the Fuel
Tax Increase account, No. 3104.06, and which consists of the

increased fuel.tax revenues created pursuant to
Resolution 397 -88.
SECTION 4. If any,provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its
approval.
