Re: Resolution for multi-year lease
Enclosed is a resolution authorizing the Office of the Prosecuting Attorney to enter into a new
multi-year lease for their Kona office in Kealakekua. This office, located at the Kealakekua
Business Center, 81-190 Haleki`i Street, Kealakekua, Hawai`i, is currently under a five year
lease with the option to extend executed and ending on June 30, 2013.
The Office of the Prosecuting Attorney is requesting that this resolution be waived from the
Finance Committee and be placed on the June 19, 2013 Council agenda in order to enter into a
new lease agreement to be executed on July 1, 2013.

A. REQUEST:
Enter into an agreement to continue to lease the 7,882 square foot office space located at identified as
Kealakekua Business Plaza Prosecutor's Office, located at 1670 Halekii Street
Kealakekua, Coutnty of Hawaii, Sate of Hawaii.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Office of the Prosecuting Attorney leases office space in the District of South Kona. The current lease
ends June 30, 2013. The proposed new lease will commence July 1, 2013 if approved.
The Office of the Prosecuting Attorney continues to service clients and complete work at the Kealakekua
office for cases located in North and South Kona Districts as well as Kau District. .

RE: Resolution No. 128-13 : A Resolution Authorizing the Payment of Funds of a Later
Fiscal Year and of More Than One Fiscal Year for a Multi-Year Lease of Real Property.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
