RESOLUTION NO. 128 13
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF
REAL PROPERTY
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or
other obligation requiring payment of funds from the appropriations of a later fiscal year or of
more than one fiscal year be approved by resolution; and
WHEREAS, the West Hawai`i Office of the Office of the Prosecuting Attorney
presently leases property in Kealakekua for office use; and
WHEREAS, by extending the lease for an additional three (3) years, the rent is to be set
at $13,798.36 per month for the first year, $14,136.50 for the second year and $14, 484.78 for the
third year, amortized improvements included, for premises located at Kealakekua Business
Plaza, 81-980 Haleki`i Street, Suite #150, Kealakekua, Hawai`i, starting on July 1, 2013; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Mayor is hereby authorized to enter into a three (3) year lease agreement for the West Hawai`i
Office of the Office of the Prosecuting Attorney located at Kealakekua Business Plaza, 81-980
Haleki`i Street, Suite #150, Kealakekua, Hawai`i.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that sufficient funds be budgeted in future fiscal years to cover the anticipated
obligations of the County under the terms of the agreement.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to:
(1) Mayor William P. Kenoi; (2) Department of Finance; and (3) Office of the Prosecuting
Attorney.
