STEWART MAEDA, being first duly sworn on oath, deposes and says:
That I am the duly appointed County Clerk of the County of Hawaii, and
make this Affidavit pursuant to Section 12-10(e) and (f) of the Hawaii County
Code 1983 (2005 Edition, as amended), hereafter ("the Code");
That pursuant to Section 12-27 of the Code and Resolution No. 98-13
adopted by the Council on May 1, 2013, the Council has received and determined
to hold a Public Hearing relating to the Water System Improvement District for
the Kona Ocean View Properties Subdivision, situate at North Kona, County and
State of Hawaii;
That pursuant to Section 12-27(d) of the Code, the notice of improvement
and hearing shall be advertised, mailed and posted in the same manner as
provided for in Section 12-10 of the Code;
That in accordance with Section 12-10(e)(1) of the Code, the Notice of the
June 4, 2013 Public Hearing were duly published in the West Hawaii Today and
the Hawaii Tribune Herald on May 15, 2013, May 17, 2013, May 22, 2013, and
May 24, 2013;
That in accordance with Section 12-10(e)(2), Hawaii County Code,
copies of the Notice of the June 4, 2013 Public Hearing were duly posted at the
Hawaii County Building, 25 Aupuni Street, Hilo, Hawaii, and at the West

Hawai'i on May 22, 2013, at least ten days prior to the public hearing;
That on May 7, 2013, in accordance with Section 12-10(e)(3) of the Code,
copies of the Notice of the June 4, 2013 Public Hearing were duly mailed to all
owners of assessment units proposed to be assessed, at least two weeks prior to
the public hearing;
