SUBJECT: Referral of the Director of the Department of Environmental Managements tho
Recommendation of Bill No.64.
Bill No. 64, amending Chapter 20, Article 2, of the Hawai`i County Code 1983 (2005 Edition, as
amended), was discussed in the Environmental Management Committee on April 30, 2013. Pursuant
to Section 2-207 of the Hawai`i County Code, committee members referred Bill No. 64 to the Director
of the Department of Environmental Management and to the Environmental Management Commission
for their review and recommendations on May 1, 2013. The Director and Commission have forty-five
days to review the bill and provide comment.
Attached please find the recommendation forwarded by the Director of the Department of
Environmental Management on May 29, 2013, regarding Bill 64.

RE: Referral of Bill No. 64 for Review and Recommendation by the Director of the
Department of Environmental Management and the Environmental Management
Commission
Dear Chair Kern,
In response to your April 30, 2013 correspondence regarding the subject Bill, I offer the
following comment:
Although Bill No. 64 would amend Hawai'i County Code Chapter 20, Article 2, adding
definitions and amending sections 20-21 through 20-23, this matter of clearing lots is
handled by the Department of Public Works (DPW). Therefore as Acting Director of the
Department of Environmental Management (DEM), I have no comment and defer to DPW.
