Resolution 38-11 authorized the lease of certain County of Hawai`i owned lands, of which these parcels are included, and required that the negotiated lease agreement for those lands be accepted by the County Council pursuant to Section 2- 114(d) of the Hawai`i County Code. Resolution 69-13, which was passed by Council on March 28, 2013, authorized the lease agreement between the County of Hawai`i and Lau Ranch for Tax Map Keys (3) 4-3-009-024, 4-3-009-053, 4-3-009-054, 4-3-009-061, 4-3-011-001, 4-3-011-062 and 4-3- 011-064. Lau Ranch has since received the right to lease additional TMK parcels (3) 4-3-011-002 and (3) 4-3-011-061. Enclosed is a resolution presenting the negotiated agreement, which includes the two additional parcels indicated above, between Lau Ranch and the County of Hawai`i the County Council pursuant to Resolution 38-11 so that it may be accepted in accordance with Section 2-114(d) of the Hawai`i County Code. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The negotiated lease agreement with Lau Ranch for Tax Map Keys (3) 4-3-009-024, 4-3-009-053, 4-3-009- 054, 4-3-009-061, 4-3-011-001, 4-3-011-002, 4-3-011-061, 4-3-011-062 and 4-3-011-064 is presented to the County Council pursuant to Resolution 38-11. Resolution 69-13 authorizing the Lau Ranch to lease parcels (3) 4-3-009-024, 4-3-009-053, 4-3-009-054, 4-3-009-061, 4-3-011-001, 4-3-011-062 and 4-3-011-064 to Lau Ranch passed 9-0. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawai`i, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review.
