COUNTY OF HAWAII ' ':,(�� ,' '' STATE OF HAWAII <br /> z= <br /> 'ATE Ci•M►.''' <br /> RESOLUTION NO. 126 13 <br /> RESOLUTION ACCEPTING THE NEGOTIATED LEASE AGREEMENT FOR HAMAKUA <br /> LANDS IDENTIFIED AS TAX MAP KEYS (3) 4-3-009-024, 4-3-009-053, 4-3-009-054, 4-3-009- <br /> 061, 4-3-011-001, 4-3-011-002, 4-3-011-061, 4-3-011-062 AND 4-3-011-064 WITH LAU RANCH, <br /> PURSUANT TO SECTION 2-114 OF THE HAWAII COUNTY CODE. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> WHEREAS, Resolution 38-11 authorized the lease of certain County of Hawai`i owned lands <br /> in the District of Hamakua, County and State of Hawaii, and required that the negotiated lease <br /> agreement for those lands be accepted by the County Council pursuant to Section 2-114(d) of the <br /> Hawaii County Code; and <br /> WHEREAS, pursuant to Resolution 38-11 negotiated agreements for those lands identified <br /> within said resolution were obtained and are hereby presented for acceptance by the County Council; <br /> and <br /> WHEREAS,Resolution 69-13 was passed on March 28, 2013 authorizing the lease agreement <br /> between the County of Hawaii and Lau Ranch for Tax Map Keys (3) 4-3-009-024, 4-3-009-053, 4-3- <br /> 009-054, 4-3-009-061, 4-3-011-001, 4-3-011-062 and 4-3-011-064; and <br /> WHEREAS, Lau Ranch received the right to lease additional TMK parcels (3) 4-3-011-002 <br /> and (3) 4-3-011-061; and <br /> WHEREAS, the negotiated lease agreement with Lau Ranch attached hereto as Exhibit"A" <br /> for Tax Map Keys (3) 4-3-009-024, 4-3-009-053, 4-3-009-054, 4-3-009-061, 4-3-011-001, 4-3-011- <br /> 002, 4-3-011-061, 4-3-011-062 and 4-3-011-064 is presented to the County Council pursuant to <br /> Resolution 38-11; and <br />
