HomeMy WebLinkAboutNTC COUNCIL 06/05/2007 Public Hearing 2006-2008 HAWAII COUNTY COUNCIL NOTICE OF PUBLIC HEARING Date: June 5, 2007 (Tuesday) Time: 6:00 p.m. Place: Sheraton Keauhou Bay Resort and Spa, 78-128 Ehukai Street Kailua-Kona, Hawaii Pursuant to Section 92-41, Hawaii Revised Statutes, notice is hereby given that the Hawaii County Council will hold a public hearing to hear testimony on: Bill No. 55, Draft 2: Relates to the establishment of the County of Hawaii Kailua Village Business Improvement District No. 1 to provide for the making and financing of supplemental services and improvements in Kailua Village in accordance with the procedures set forth in Chapter 35, Hawaii County Code. These services and improvements would be implemented in accordance with the Kailua Village Business Improvement District Plan, which would be administered by the District Association. The Plan, the organization and powers of the District Association, and the area proposed to be specially assessed are described in Bill No. 55, Draft 2. Pursuant to Section 35-12(b), Hawaii County Code, a notice was sent to each owner of land proposed to be included and assessed in the proposed Kailua Village Business Improvement District No. 1. "Landowner" or "owner of land" is defined as the owner of real property to whom the real property tax is assessed as shown on the real property tax assessment list, which may be the fee simple owner and/or the lessee of land, regardless of whether such owner is exempt from the payment of such tax. Protests may be submitted by landowners within the proposed District. Protests by landowners against Bill No. 55, Draft 2 shall be made in writing before the conclusion of the public hearing by filling out a Declaration of Protest form available from the Clerk's Office. Written protests may be withdrawn by the landowner using a Withdrawal of Protest form before the conclusion of the public hearing. Testimony of all interested persons and landowners/lessees for or against the establishment of the district, the extent of the district, and the levy of a special assessment will be heard at the public hearing. Additionally, a brief presentation will be provided about the proposed improvement district and the improvement district process at the beginning of the public hearing. Those persons wishing to testify in person must register with the Council/Clerk's staff prior to the convening of the hearing. Those testifying in person and submitting written testimony should bring 17 copies of the testimony for distribution at the meeting. Those persons unable to testify in person may submit testimony (1) by mail to the County Clerk's Office, 25 Aupuni Street, Hilo, Hawaii, (2) by facsimile to (808) 961-8912, or (3) by email to counciltestimony(a�co.hawaii.hi.us.
