As part of this process, the Endangered Species Act, Section 7 clearance is required. The Ane Keohokalole Highway Project encroached into a portion of the 3.43 acre Aupaka Preserve located adjacent to the project and within the Kealakehe ahupuaa. The agreed mitigation for project impact is for the County to pay the U.S Department of the Interior Fish and Wildlife Service (USFWS) $35,000. These funds will be used for Aupaka preservation efforts. Enclosed is a resolution authorizing the Mayor to enter into an agreement with the USFWS to provide these funds to this organization. The Department of Public Works requests that this bill be waived from the Finance Committee and be placed on the July 10, 2013 Council Agenda. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The Ane Keohokalole Highway Project encroached into a portion of the 3.43 acre aupaka (isodendrion pyrifolium) preserve located adjacent to the project and within the Kealakehe ahupuaa. As part of the Endangered Species Act (ESA) Section 7 mitigation efforts, FHWA in a letter to the USFWS dated March 10, 2010 committed $35,000 for the Aupaka preservation efforts. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawai`i, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review. However, in the event this request is denied, for whatever reason, I understand the matter shall be referred to the Committee on Finance for placement on its future agenda.
