Full amount of distribution to owners who sold their property on cash basis and paid the balance of assessment. 2. Partial payments: A. To original owners up to the time of assigning assessment to new owner. B. To new owner from date of assuming assessment. 3. No distribution should be made to new owners who paid cash for the properties to original owners. A. Reason: In order to convey title to new owner, original owner must pay assessment balance, except when buyer elects to pay for the balance in which case condition of item (2) applies. 4. Further justification: A. Unless a clause in the sales contracts states that the condition of sale also includes refund from the county, new owner is not entitled to the reimbursement. Bottom Line: A. Reimbursement should be made to whoever paid for the assessment. A favorable consideration on the above matter will be greatly appreciated. Sincerely, CA. ti ter b.
