COUNTY OF HAWAII < / - _ I STATE OF HAWAII BILL NO. 97 ORDINANCE NO. /a 90 AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 11, DIVISION 1, SECTION 24- 302 OF TIIE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO THIRTY-FIVE MILE PER HOUR SPEED LIMIT ON PRIVATE STREETS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this measure is to establish speed limits in the Hawaii County Code for the Hawaiian Paradise Park Subdivision so that speed limits can he properly enforced by the police. Pursuant to Section 24-2 of the Hawai`i County Code, the County shall not be responsible for the maintenance and repair of any private street, highway, or thoroughfare when it imposes or enforces traffic regulations and highway safety laws on that private street, highway, or thoroughfare. SECTION 2. Chapter 24, article 11, division 1, section 24-302, schedule 6 (Reserved), of the Hawaii County Code 1983 (2005 Edition. as amended), is amended to read as follows: "Section 24-302. Schedule 6. [Reserved] 35 mile per hour limit. A speed limit of thirty-five miles per hour is established as set forth in this schedule upon the private streets or portions of private streets as follows: (a) Hamakua (b) North Hilo fc) South Milo (d) Ka'u O Kohala (f) Kona (g) Puna ( ) Hawaiian Paradise Park Subdivision, Shower Drive, Kaloli Drive, Paradise Drive and Maku`u Drive." SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end. the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
