REGARDING: Comm. No. 421/Bill No. 129
DATE: September 17, 2013
LOCATION: Council Chambers, Hilo, Hawai`i
TITLE: An Ordinance Amending Chapter 14, of the Hawai`i County Code 1983
(2005 Edition, as Amended), by Adding a New Article Relating to a
Hydraulic Fracturing Policy.
EXPLANATION: This bill prohibits hydraulic fracturing or the practice of hydraulic
fracturing by any other name in the County of Hawai`i.
Council Members discussed:
(1) That this is a County home rule issue;
(2) Concerns that hydraulic fracturing uses large amounts of water and
chemicals that would contaminate ground water and reefs;
(3) Concerns that hydraulic fracturing could cause an increase in
earthquakes;
(4) That Hawaiian cultural beliefs and practices need to be respected, and
(5) The penalty fines need to be increased.

RECOMMENDATION: Your Committee on Agriculture, Water and Energy sustainability is in
accord with the purpose and intent of Bill 129, as amended, and
recommends its passage on first reading.
