COMMITTEE ON FINANCE
REPORT NO. 628
(AMENDED)
By a motion duly made and seconded, the County Council
amended Finance Committee Report No . 628, by adding Puainako
Extension as a project to the Hawaii County Council ' s 1993
Legislative Package. The motion was carried with Mrs . Hale and
Miss Lai voting "no" on the procedure to amend a committee
report .
Further, Mr . Domingo requested approval to submit the
Hawaii County' s Legislative Package, with the exclusion of the
CIP items, to the HSAC Executive Committee for consideration in
the HSAC Legislative Package. There was no objection.
FC Report 628, as amended, was unanimously adopted.

Your Committee on Finance, to which was referred Communication
Nos . 4039 , 4234 , and 4235, reports as follows :
Communication Nos . 4039 , 4234 , and 4235 submit the following
proposals for consideration as part of the Hawaii County Council ' s
Legislative Package.
a . Communication 4039 :
1. $250, 000 to send a Hula Halau to represent the State
of Hawaii on an international exhibition tour .
b. Communication 4234 :
1. $1 . 5 million for signalization of Konawaena
Intersection Improvements .
2 . $1 . 9 million for Lako Street Extension. (Connection
to Alii Drive) .
3 . Kainaliu Town bypass road. (Hopefully, a State
Highway undertaking) .
4 . Water source development in North and South Kona.
c. Communication 4235 :
1. Amend Chapter 269 of the Hawaii Revised Statutes,
regarding E-911.
2 . Amend Section 46-16 . 7 of the Hawaii Revised
Statutes, County general excise and use tax
surcharge.
3 . Amend Section 46-41 of the Hawaii Revised Statutes,
Biennial Budgeting for Counties .
The Committee on Finance concurs with the proposals in Communication
Nos . 4039 , 4234 and 4235 and recommends that they be made a part of
the Hawaii County Council ' s Legislative Package.

FINANCE The Committee on Finance Concurs with the proposals in
COMMITTEE Communication Nos . 4039 , 4234 and 4235, and
REPORT 628 : recommends that they be made a part of the Hawaii
County Council ' s Legislative Package, was read.
Mr. Arakaki moved to approve Finance
Committee Report 628 . Seconded by
Miss Lai .
CHR. SCHUTTE: It ' s been moved and seconded that we
approve Finance Committee Report 628 . Mr . Domingo.
MR. DOMINGO: Mr . Chairman, with the exclusion of the
CIP items, could we also use this package as a
submittal into to the HSAC Executive Committee for
consideration to be included in the HSAC package?
CHR. SCHUTTE: I have no problem with that . Does
anybody have a problem with that?
(There were no objections . )
CHR. SCHUTTE: So noted. Mr . De Lima .
MR. DE LIMA: Is it possible to add something to this
thing?
CHR. SCHUTTE: I beg your pardon.
MR. DE LIMA: Can we add it now?
CHR. SCHUTTE: Mr . Domingo .
MR. DOMINGO: I have no problem.
CHR. SCHUTTE: Go ahead.
MR. DE LIMA: I 'm amending a report, that ' s why.
MRS. HALE: I have a problem with that . It ' s not
parliamentary procedure to amend the report . We
cannot do that, according to Robert ' s Rules of
Order . You cannot amend a report . I would suggest
that if you have another project, that you put it out
and go through the procedure. We still have time to
send it on to HSAC.
MR. DE LIMA: I believe we can amend the report .

AMENDMENT: Mr . De Lima moved to amend Finance
Committee Report 628 by adding the
Puainako Extension. Seconded by
Mr. Alonzo.
CHR. SCHUTTE: It ' s been moved and seconded that we
amend Finance Committee Report 628 and add on an
additional portion.
MRS. HALE: That ' s not according to parliamentary
procecures .
CHR. SCHUTTE: Do you want to make that addition,
Mr. Domingo?
MR. DOMINGO: I---
MR. DE LIMA: Yeah, we just add the Puainako
Extension.
CHR. SCHUTTE: Mrs . Hale.
MRS. HALE: Well , Mr . Chairman, I don' t think we' re
following Robert ' s Rules of Order . But beyond all of
that, Mr . Chairman, it ' s been called to my attention
that the State told a community group in your
district, Mr. De Lima, that if we turn this road over
to the State, they'd have it done by now.
I think, rather than trying to do this project
ourself, that it would be well for us to look into
that statement and see if there ' s any truth in it.
That we maybe could ask the State to take this whole
project on.
Puainako Street is really a State highway. So,
therefore, the Puainako Extension should be part of
the State highway system; and it should be a State
project, not a County project . I have no objection
to, you know, asking the Legislature to put it on,
and I 'm sure the local legislators will back that up.
But what I 'm saying is, I think we should look
further into this and maybe take the tack that let
the State do this project . If they can do it faster
than we can do it, so much the better. You should
check that statement out with Mr . Hugh Ono. Thank
you. It ' s in your district .
CHR. SCHUTTE: Mr . De Lima .

MR. DE LIMA: Actually, I was at that meeting; and
Mr . Ono and the State Highway is involved in the
project . The EIS process is going through. The
County is trying to assist and facilitate it . But
basically all I 'm saying is that this project may be
connecting an area that ' s in my district; but
obviously, it flows as a service to the entire
community area .
But I 'm sure we all support the matter . I just
wanted to make sure it ' s part of our priorities .
Because of lot of development in the future can only
occur once we get the infrastructure in. Thank you.
CHR. SCHUTTE: Mr . Ruddle.
MR. RUDDLE: Mr . Chairman, you know, this brings to
light black & white information and statements that
were made by the State Highways regarding Palani
Road. They were going to take over Palani Road in
1991 when we brought it to State standards, and they
never did. Consequently, the County still has Palani
Road, and we ' re maintaining it .
So, you know, I don' t know if there ' s any validity in
a statement of that effect . We had it in writing,
and they never took it . I think the older Councilmen
who will all remember those statements that we
resurface and, you know, make improvements to Palani
Road, and then they would take it over, and they
never have.
So, you know, as long as, Mr . De Lima, your motion is
on the floor, I could support it as long as we don' t
have a conflict in the legal side.
CHR. SCHUTTE: Mrs . Hale.
MRS. HALE: I don' t think any of us are against
asking the State Legislature to give us the money for
Puainako Extension--I think that should be made very
clear . We ' re all for the Puainako Extension; we all
know that it should be done, and it should be done
the fastest way possible .
We should look into trying to expedite it ourselves,
or getting the State to do it through the
Legislature, or so forth. I am concerned, however,

about procedure of amending a committee report by
adding a major thing on there that was not publicized
in the agenda, and it was not part of the committee
report .
I don' t really think it ' s the legal process by which
we should be doing this . On that basis,
Mr . Chairman, I 'm going to object to the amendment.
I will vote for the report as amended, but I will
object to amending the report . Because when we start
amending committee reports on the full Council level
without letting people know 7 days in advance, I
think we ' re very much in violation of the
Sunshine Law. We ' re discussing an area that the
public has not been alerted that we were going to
discuss at all .
So, I will vote against the amendment but, you know,
if it passes, I will vote for the report as amended.

CHR. SCHUTTE: Right now, we have an amendment to the
Committee Report 628 which includes the Puainako
Extension be added on. No further discussion?

CHR. SCHUTTE: Let the record so note, the motion is
carried. The Chair will call for a vote on the main
motion of Finance Committee Report 628, as amended.

carried.
