Your Committee on Finance, to which was referred Bill No . 684 ,
reports as follows :
The purpose of Bill No . 684 is to amend Ordinance No . 92-73 , the
Operating Budget for the fiscal year ending June 30, 1993 , by
appropriating $369 , 852 into the General Fund 3304 . 73 , State Grants,
West Hawaii Parks Lifeguards, and appropriating same to the following
expenditure accounts :

The Committee on Finance understands that these funds were received
in July, 1992 from the State Department of Land and Natural Resources
to provide lifeguard services at Kealakekua Bay State Historical
Park, Old Kona Airport State Recreational Area, and Kona Coast State
Park for the safety and protection of park beach users .
Pursuant to Section 13-13 of the County Charter, the County may enter
into contracts with the State for the performance of any function or
activity which the County is authorized to perform.
The Committee also understands that the Mayor of the County of Hawaii
has entered into a contract with the State of Hawaii to provide
lifeguard services to these State Beach Parks and to hold the State
harmless of all liabilities arising out of any activity of the County.

The Committee has expressed concern about the hold harmless clause to
the State. The Committee understands that the $157, 000 is the yearly
insurance premium for $1, 000, 000 liability coverage for each incident
at the three (3) State beach parks as well as all County beach parks .
The Committee understands that all of the W HI Lifeguard Serv.
accounts are new expenditures accounts .
The Committee further understands that funding for the W HI Lifeguard
Service is an annual State funding and appropriations from the State
' must be made yearly.
The Committee on Finance would like to have a copy of the insurance
contract for review before the next Council meeting .
The Committee on Finance concurs with the intent and purpose of
Bill No . 684 and recommends that it pass first reading .
