Your Committee on Finance, to which was referred Resolution No . 527-92, reports as follows : The purpose of Resolution No . 527-92 is to authorize the Mayor to enter into an agreement to purchase three (3) parcels of land for park property in Pohoiki and that $20, 000 be transferred from 010-911-5911. 13-341, the Contingency Account, to 010-801-5801.33-341, the Capital Project Account, for the purchase agreement and the cost of the environmental assessment . Pursuant to Section 61-2 (2) of the Hawaii Revised Statutes, each county has the power to purchase real property within its defined boundaries and to manage and dispose of the same. Section 61-2 (4) of the Hawaii Revised Statutes, further states that each county has the power to make contracts and to do all things necessary and proper to carry into execution of the foregoing powers . Section 101-3 of the Hawaii Revised Statutes states that in the event the county enters upon privately-owned property by authority of an agreement to acquire the real property by voluntary action of the parties, the county is required to: 1) Reduce the agreement in writing . 2) File the executed written agreement promptly in the bureau of conveyances . 3) Complete its part of the agreement, including payment in full of any money within the period of two years immediately succeeding the date upon which the agreement is filed. The Committee understands that the $20, 000 will be transferred from the 010-911-5911. 13-341, the Contingency Account, and transferred into 010-801-5801.33-341, the Capital Project account . The $7, 000 is a refundable deposit and the balance is to be used for the environmental assessment . FC REPORT No. 622 ADOPTED: OCT 2 1 1992 FC- 622 Page 2 October 5, 1992 The Finance Committee understands that the Federal Emergency Management Agency (FEMA) has approved a proposal by the County to replace these lost beach parks with two new parks in the Puna district and will fund 75% of the approved costs of the new parks, including land acquisition. The Committee further understands that the final sale of the land is contingent upon the following factors : 1) Water quality study indicating that the water and water circulation in the swimming pond are clean enough to support water activities by the public. 2) Final commitment of funds by FEMA. The Committee on Finance concurs with the intent of Resolution No. 527-92 and recommends its adoption.
