Re: Amendment to the Hawaii County Code
Enclosed is a bill for an ordinance amending section 12-17 of Chapter 12, Article 2 of the
Hawai`i County Code, related to Improvement District assessments. The purpose of this bill is
to clarify the procedures for, and usage of, the combined hearing process.
Chapter 12, Section 28 allows two public hearings to be combined into a single public hearing
in order to streamline the process. This bill primarily clarifies the procedures and will more
clearly allow the final details of plans and specifications to be prepared after a combined public
hearing. Additionally, the bill adds a 10% cost overrun threshold into section 12-17. This
addition clarifies what is materially significant on a cost basis that would trigger a second public
hearing.

A. REQUEST:
Changes are requested to Chapter 12 of the Hawaii County Code, Improvements by Assessments, to
clarify the procedures for and usage of the combined public hearing process. This will aid in expediting the
improvement district process.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Establishing an improvement district can require multiple resolutions and public meetings. Time is of
essence not only for the building of the infrastructure, but there may be adverse financial consequences for
the property owners in the improvement district when the process takes a couple of years.
Chapter 12, Section 28 allows for a more streamlined process by combining two public hearings into a
single public hearing. The requested changes will more clearly allow the final details of plans and
specifications to be prepared after the initial public hearing that is referenced in Section 12-10 when using
the combined hearing. Furthermore, a 10% cost overrun threshold has been inserted. This addition clarifies
what is materially significant on a cost basis that would trigger a second public hearing.
