The Planning Director requests that the subject resolution be placed back on the Finance
Committee agenda for the November 5th meeting. He also requests that the attached letter from
the attorney representing Kohala Kai, LLC be entered as a communication pertaining to the
resolution.

Dear Mr. Kanuha:
By letter dated July 1, 2013, the Mayor transmitted the Kohala Kai Subdivision Grant of
Public Access Easements for the County Council's consideration. At the July 23, 2013 County
Council Committee on Finance hearing, Resolution 140-13 was postponed. It is our
understanding that the deadline for placement on the November 5, 2013 Committee on Finance
agenda is October 17, 2013. Please set this matter on the agenda for the November 5th hearing.
This will confirm that Kohala Kai, LLC understands that the North Kohala Community
Development Plan Action Committee and other community members would like Kohala Kai,
LLC to consider alternative alignments for the public access easements. Since Kohala Kai, LLC
has already constructed the public access improvements, it has declined the alternative
alignments. Therefore, Kohala Kai, LLC will not amend the Grant of Public Access Easements
(as fully executed by Kohala Kai, LLC, the Mayor and the Planning Department, and approved
as to form by the Corporation Counsel), and request that this matter be scheduled as noted above.
