• <br /> COUNTY OF HAWAII '•_ �" �• STATE OF HAWAII <br /> RESOLUTION NO. 206 13 <br /> RESOLUTION AUTHORIZING THE MAYOR TO PROVIDE EASEMENTS, <br /> LICENSES, PERMITS OR OTHER AUTHORIZATION REASONABLY NECESSARY <br /> FOR THE LEASES ON LOT 3A (TAX MAP KEY NO. [3] 2-4-001-177) AND LOT 3B <br /> (TAX MAP KEY NO. [3] 2-4-001-184). <br /> WHEREAS, by Resolution No. 709 08, the Council authorized the lease of the land in <br /> Hilo, Hawaii that was transferred to the County of Hawai'i by the Governor of the State of <br /> Hawai'i by Executive Order 4224 for the purpose of planning, developing and operating <br /> affordable rental housing for senior citizens and authorized the Mayor to execute said Lease with <br /> Hawai'i Island Community Development Corporation ("HICDC"); and <br /> WHEREAS, said Lease was thereafter executed by the Mayor and HICDC; and <br /> WHEREAS, in order to develop the first phase of the affordable rental housing for <br /> senior citizens, HICDC formed a new entity, Mohouli Senior Housing Phase 1 LLLP ("Mohouli <br /> Senior") whose general partner is a wholly owned subsidiary of HICDC; and <br /> WHEREAS, the initial Lease between the County of Hawai'i and HICDC was amended <br /> to allow Mohouli Senior to lease the upper portion of said land (which became Lot 3A Tax Map <br /> Key No. [3] 2-4-001-177) and to allow HICDC under the initial Lease to continue planning and <br /> development for later phases of development on the lower portion of said land (which became <br /> Lot 3B Tax Map Key No. [3] 2-4-001-184); and <br /> WHEREAS, Mohouli Senior is completing construction of 60 affordable rental units for <br /> senior citizens on Lot 3A; and <br /> WHEREAS, in order to use the leased areas, Mohouli Senior and HICDC need to have <br /> various easements for access and utility purposes provided for Lots 3A and 3B and may require <br /> licenses or other authorizations affecting said lots to allow use of the leased areas; now, <br /> therefore, <br />
