Your Committee on Public Works to which was referred Communication
1769 .1 and its attached Bill No . 651 , reports as follows:
Bill No . 651 proposes to amend Chapter 24 , Article 10 of the Hawaii
County Code 1983 related to traffic regulation by adding a new item
to Section 24-255 , Schedule 3 , relating to twenty-five miles per hour
speed zones and by changing item 15 in Section 24-257 , Schedule 5 ,
relating to thirty-five miles per hour speed zones . The purpose of
the bill is to lower the speed limit from thirty-five miles per hour
to twenty-five miles per hour on Kamehameha Avenue from Kalanianaole
Street to Pauahi Street during the Wailoa Bridge construction period .
Your Committee on Public Works has reviewed Bill No . 651 and
understands that the lower speed was requested by Alvah Miyamoto ,
District Engineer , Department of Transportation , to provide traffic
control and enforcement powers to the police for the duration of the
Wailoa Bridge replacement .
Your Committee understands the following:
1 ., Kamehameha Avenue from Kalanianaole Street to the junction of
• Route 19 across from Hilo Iron Works is under State
jurisdiction .
2 . Kamehameha Avenue from Route 19 to Pauahi Street is under
County jurisdiction .
3 . The County has the power to set speed limits on County roads
but does not have the power to regulate speed on State roads .
4 . The State has the power to set speed limits on State roads .
5 . Better enforcement of the lower speed limit on Kamehameha
Avenue should result from the County setting the limit on its
part and the State setting the limit on its segment .
6 . Accordingly, Corporation Counsel amended the bill as
Bill No . 651 , Draft 2 .
7 . The present Section 24-257 of the Hawaii County Code has a
minor error , as the correct name is Kalanianaole Street , not
Kalanianaole Avenue .
Your Committee Chairwoman noted that a typographical error in
spelling "Ironworks" as one word had been corrected to "Iron Works . "
She also stated that the proposed ordinance is a temporary measure .

One of your committee members was concerned about the bill ' s lack of
any reference to the 25 miles per hour speed zone being in effect
only until the Wailoa Bridge project is completed . The Deputy Chief
Engineer testified that the Department of Public Works would remember
in two years that the speed zone was only temporary. At the
Chairwoman 's request, the Chief Engineer agreed to suggest to
Alvah Miyamoto that the 25 miles per hour speed zone be tied to a
certain time, such as 60 days , after project completion .
Your Committee concurred with the Chairwoman ' s recommendation to
approve Bill No . 651 Draft 2 .
Your Committee on Public Works is in accord with the intent and
purpose of Bill No . 651 Draft 2 and recommends its passage on first
reading by the County Council .
