Your Committee on Public Works to which was referred Communication
/No . 1713 and Resolution No . 473-88 , reports as follows:
The purpose of Resolution No . 473-88 is to abandon a roadway parcel
along the Belt Road fronting Hookena Elementary School in Kauhako ,
South Kona . The roadway parcel is shown on the map attached to the
resolution and marked Exhibit A.
Resolution No . 473-88 states that the County has no further use for
the roadway parcel; access to property in the area will not be
affected; and the State of Hawaii , Department of Accounting and
General Services has recommended that the County quitclaim the
roadway parcel to the State of Hawaii , Department of Transportation .
Your Committee understands that the County holds the roadway parcel
in fee simple.
Communication No . 1713 is a transmittal letter from the Chief
Engineer explaining that the roadway parcel of 221 square feet is a
portion of the Hookena School lot that overlaps with the Belt Road
and that this portion of Hookena School belongs to the County .
Your Committee considered Resolution No . 473-88 on July 26 , 1988 .
Your Committee concurred with the Chairwoman ' s recommendation to
defer Resolution No . 473-88 because it lacked Exhibit A and didn 't
cite the authority for the proposed abandonment .
Your Committee considered Resolution No . 473-88 again on October 24 ,
1988 . The Committee Chairwoman stated that Exhibit A had been
received and that in response to the Chief Engineer 's request,
Corporation Counsel assisted in preparing Resolution No. 473-88
Draft 2 , which adds a paragraph citing the authority as follows :
"BE IT FURTHER RESOLVED that the Finance Director of the
County of Hawaii be directed to dispose of said roadway parcel
in accordance with Section 2-118 (b ) , 2-120 (a ) and 2-120 (b ) of
the Hawaii County Code 1983 . "

Your Committee understands that remnants may be disposed of without
recourse to public auction in accordance with Section 2-118 (b ) ; that
the Council may by resolution direct the Finance Director to
negotiate the disposition of real property by selling it in fee
simple in accordance with Section 2-120 ( a ) ; and that disposition of
real property to governmental agencies may be made without notice or
appraisal in accordance with Section 2-120 (b ) .
Your Committee amended Resolution No . 473-88 to accomplish the
following:
1 . Declare that the subject roadway parcel is a remnant;
2. Direct the Finance Director of the County of Hawaii to
dispose of the remnant roadway parcel in accordance with
Section 2-118 (b ) , 2-120 (a ) and 2-120 (b ) of the Hawaii
County Code 1983;
3 . Quitclaim all interests in the roadway parcel to the
State of Hawaii , Department of Transportation; and
4 . Add the Department of Transportation as a recipient of a
copy of the resolution .
Your Committee finds that the abandonment and disposition by
quitclaim deed of the remnant roadway parcel is proper .
Your Committee on Public Works is in accord with the purpose of
Resolution No. 473-88 Draft 2 and recommen.'s ' ts adoption by the
County Council .
