Your Committee on Public Works to which was referred
Communication No . 1682 and its attached Resolution No. 464-88 ,
reports as follows:
The purpose of Resolution No . 464-88 is to authorize the County to
enter into a maintenance agreement with the State for the maintenance
of the State 's highway street lighting system on the island of
Hawaii . The term of the agreement continues until the contract is
amended or terminated . Either the County or the State can terminate
the contract with six month ' s notice .
Your Committee finds that Council action is required by both the
Charter and the Hawaii Revised Statutes .
Section 10-11 of the County Charter states that "any contracts,
lease or other obligation requiring the payment of funds from the
appropriations of a later fiscal year shall be made or approved by
resolution. "
Section 264-44 , Hawaii Revised Statutes, states that the Director of
Transportation may have maintenance work on federal-aid highways
"performed by the county road department, by public employment or by
contract , upon authorization of the council . Expenditures for the
maintenance work shall be made from the state highway fund. "
Section 264-44, Hawaii Revised Statutes , states that the Director of
Transportation may have maintenances of the state highway system
"performed by the county in which the highways are situated , by
public employment or by contract , upon authorization of the
legislative body of the county concerned . "
Your Committee understands that the maintenance agreement would
formalize an oral agreement reached by the Chief Engineer and the
Director of Transportation about a year and a half ago for County
maintenance of State street lights on State highways . Under this
agreement, the State reimburses the County monthly for its expenses

plus five percent for administration . The State also agrees to
indemnify, defend and hold harmless the County for loss, liability or
damage , except that arising out of negligence or willful misconduct
of the County in connection with the Street Light Maintenance
Agreement .

Communication No . 1682 from the Chief Engineer explains that the
State ' s 350 street lights make up six percent of the total number of
highway street lights on the island . The State will pay the County
for its costs to maintain the street lights and the additional work
will not significantly affect the County ' s street lighting program .
Your Committee understands that the Department of Public Works has
been maintaining street lights on State Highways and started charging
the State for the actual expenses a year and a half ago . The County
has a joint pole agreement with Helco and Hawaiian Telephone but the
State does not and therefore can ' t maintain its street lights and has
relied on the County to do it .
Schedules A, B and C, referred to in Resolution No . 464-88 as
describing the State ' s payments for the County ' s maintenance of
street lights on State highways , show the basis for the monthly
costs. Schedule A is the electricity in KWh; Schedule B is the
maintenance costs and Schedule C is the joint pole maintenance cost
per pole . Staff research shows that the estimated average monthly
costs , based on June 1988 data, total $4,573. 82 and can be broken
down as follows:
1 . Energy (Kwh) $2, 9761 . 14
2. Maintenance 495 . 94
3. Joint pole maintenance 888 . 94
4. Administrative charge 217 . 80
The estimated total annual cost is $54, 886 .
Maintenance of street lights is paid out of the Highway Fund and
State payments to the County are reimbursements to the Highway Fund .
Your Committee heard testimony from the Chief Engineer that the State
payments to the County previously fell short of the County' s cost for
maintenance of street lights and the agreement provides for State
reimbursement of the County ' s actual costs .
Your Committee on Public Works is in accor. wi h the purpose of
Resolution No . 464-88 and reco mends its adoprion by the County
