Chairman and Members Hawaii County Council Hilo , Hawaii 96720 Your Committee on Public Works to which was referred Communication /No . 1578 to 1578 . 3 , reports as follows : Communication 1578 is a request dated April 11 , 1988 from Bill Kikuchi for a sign variance for the Nani Mau Gardens at 421 Makalika Street in the Panaewa Farms Lots, Hilo. The letter states that approval of the Nani Mau Gardens ' plans has been given by the Hawaii County Planning Commission and is being requested from the State Land Use Commission by the Hawaii County Planning Department . Communication 1578 .1 is a memo from the Planning Director commenting that the department has no objection to the variance , based on the State Land Use Commission' s actions as follows : 1 . Granting of a Special Permit to allow establishment of a commercial arboretum on land zoned agricultural (A-10a ) . 2. Amendment of the Special Permit to allow related commercial uses . Communication 1578 . 2 from the Chief Engineer states that "granting the variance in total . . .would be contrary to the spirit and purpose of the sign regulation" and offers the following: 1 . Concurrence with the use of signs permitted in a business district and the use of two temporary 16 square feet ground signs ; 2. An ' observation that the entry and exist ground signs are not in accordance with the sign regulations; and 3 . A solution to the entry and exit ground signage that is in accord with the sign regulation . Communication No . 1578 . 3 from Bill Kikuchi dated June 6 , 1988 states the following: 1 . He and Nani Mau Gardens are in agreement with Chief Engineer Ono 's suggestions for signage; 2. He looks forward to favorable action by the Committee as Nani Maui Gardens will have a hardship without the variances ; and 3. He will not be able to attend the Committee meeting as he must be on Oahu . PWC REPORT .';O , 258 ADOPTED : JUN 15 1988 PWC- 258 Page 2 June 7 , 1988 Your Committee is aware that the proposed amended request for signage in an agricultural district meets the County Code requirement for permissible signs in commercial and industrial districts, as specified in Section 3-29 (a ) items 1 (ground sign ) and 5 (wall sign ) . The type and number of signs would conform with Section 3-35 of the Hawaii County Code . Your Committee finds that the enforcement of the provisions of the Hawaii County Code , Section 3-27 , relating to Agricultural Districts , would work a hardship on the applicant . Your Committee further finds that granting the variance in the form recommended by the Chief Engineer would not be contrary to the spirit and purpose of the County 's sign ordinances and the public interest . Your Committee on Public Works recommends ap•roval of the variance request as amended by incorporating the Chie Engineer ' s recommendation for the entry and exit signs . III 0 M "' LE K.
